QMB Billing Protections Mississippi: How to Stop Illegal Balance Bills

The Federal Law Providers Keep Ignoring

Under 42 U.S.C. § 1396a(n)(3)(B), a QMB beneficiary has no legal liability to a provider or managed care organization for Medicare cost-sharing when Medicaid's payment is reduced or eliminated under the federal lesser-of rule. That means zero deductibles, zero coinsurance, and zero copayments for any covered Medicare service.

This applies to hospitals, physicians, labs, imaging centers, durable medical equipment vendors, and skilled nursing facilities. It applies to both Original Medicare and Medicare Advantage providers. It's not optional — it's federal law.

And yet Mississippi providers routinely send balance bills to QMB enrollees.

Why the Bills Keep Coming

Mississippi Medicaid reimburses providers for QMB cost-sharing under a "lesser-of" payment rule. Medicaid pays either the full Medicare cost-sharing amount or the difference between the Medicare payment and the state Medicaid fee schedule rate — whichever is less.

In practice, the Medicare fee schedule rate often exceeds the Mississippi Medicaid rate. When that happens, Medicaid's payment to the provider is $0.00. The provider sees a zero-dollar Medicaid remittance and assumes they can bill the patient for the gap.

They cannot. A $0.00 payment from Medicaid does not authorize billing the QMB enrollee. The provider must accept the Medicare payment plus the $0.00 Medicaid adjudication as payment in full.

How to Dispute an Illegal QMB Bill

If your parent receives a bill or collection notice for Medicare cost-sharing while enrolled in QMB, follow this sequence:

Step 1: Check the dates. Compare the date of service on the bill against the QMB effective date on the DOM approval notice. QMB coverage starts the first day of the month after approval — services rendered before that date are not protected.

Step 2: Send a written dispute. Contact the provider's billing department in writing. Include a copy of the DOM approval notice, the Medicaid card showing QMB status, and a clear statement citing the federal prohibition.

Step 3: Escalate to CMS. If the provider doesn't respond or continues billing, call 1-800-MEDICARE (1-800-633-4227) and explain that a Medicare provider is billing a QMB beneficiary for Medicare-covered cost-sharing. Give the provider's name and NPI if you have it. CMS can advise the provider to stop billing and refund any improper payments.

Step 4: Get legal help. If collection agencies get involved, contact Mississippi Legal Services at 1-800-982-2550 for free legal assistance.

The Copay Question

QMB-Only enrollees owe nothing for Medicare-covered services — no copays, no coinsurance, no deductibles. QMB-Dual enrollees (those with both full Medicaid and QMB) may owe standard nominal Medicaid copayments for certain Medicaid-covered services, but never for Medicare cost-sharing.

If a doctor's front desk asks your QMB-enrolled parent for a copay at check-in, they should present their Medicaid card and explain they have QMB status. The practice should verify coverage through the DOM eligibility system before billing.
