QMB Billing Protections Massachusetts: Stopping Illegal Balance Bills
Your parent is enrolled in QMB — the Medicare Savings Program that is supposed to eliminate all Medicare cost-sharing. Then a bill arrives from the hospital for $400 in coinsurance. It should not exist, and you do not have to pay it. But getting it resolved requires knowing the law and the right escalation path.
Why the Bills Show Up
Federal law — specifically 42 U.S.C. 1396a(n)(3) — prohibits any Medicare-enrolled provider from balance billing a QMB member for Medicare Part A and Part B deductibles, coinsurance, or copayments. The protection is absolute. It applies whether the provider is in Original Medicare, a Medicare Advantage network, or even a provider who is not formally enrolled as a MassHealth Medicaid provider.
The problem is that medical billing software does not always know your parent has QMB coverage. Automated billing systems generate balance bills based on the difference between the Medicare-approved amount and what Medicare paid. These systems are designed for the general Medicare population, where patients owe that difference. For QMB members, the provider is supposed to absorb it — but the software sends the bill anyway.
MassHealth processes secondary QMB claims using a "lesser-of" payment rule: the state pays the difference between the Medicaid fee schedule rate and the Medicare payment, or nothing if the Medicaid rate is lower. Even when MassHealth's secondary payment is $0, the provider cannot pass that cost to the patient. A $0 state payment does not create a right to bill the beneficiary.
How to Stop an Improper Bill
Follow these steps in order:
1. Confirm QMB coverage. Verify that your parent was actively enrolled in QMB (MassHealth Senior Buy-In) on the date the medical service was rendered. If coverage had not started yet, the billing protection does not apply for that date.
2. Check what the bill covers. QMB protections apply to Medicare-covered services — Part A deductibles, Part B deductibles, coinsurance, and copayments. Non-covered services (cosmetic procedures, services Medicare does not recognize) fall outside the protection.
3. Contact the billing office in writing. Call first to flag the issue, then follow up with a written communication that includes:
- A copy of your parent's MassHealth card showing QMB/Senior Buy-In coverage
- The MassHealth Notice of Decision confirming QMB approval
- The Medicare Summary Notice (MSN) or Explanation of Benefits (EOB) for the service in question
- A clear statement that billing a QMB member for Medicare cost-sharing violates federal law
4. Cite the law. State in writing that balance billing a QMB beneficiary violates 42 U.S.C. 1396a(n)(3) and subjects the provider to CMS sanctions and state consumer protection penalties. Most billing departments resolve the issue at this stage.
5. Escalate if needed. If the provider refuses to write off the balance or sends the bill to collections:
- File a complaint with 1-800-MEDICARE
- Report the billing violation to MassHealth Customer Service at 1-800-841-2900
- Contact the Massachusetts Attorney General's Consumer Advocacy & Response Division
- Reach out to a local legal aid organization — Greater Boston Legal Services and Community Legal Aid handle these cases for low-income seniors at no cost
Medicare Advantage Plans and QMB
QMB billing protections apply equally to Medicare Advantage (Part C) networks. If your parent is in a Medicare Advantage plan and receives a bill for plan copayments or deductibles, the same rules and escalation steps apply. The provider cannot charge a QMB member for Medicare Advantage cost-sharing on covered services.

Keeping a Record
Document every bill, every call, and every written communication. If the provider sends the account to a collection agency, having a paper trail showing that you disputed the bill and cited the legal protection strengthens your position substantially — both with the collection agency and with any regulatory complaint.
The Massachusetts Medicare Savings Programs Guide includes a billing dispute letter template and a step-by-step escalation checklist designed specifically for QMB billing violations.
