QMB Billing Protection in Montana: What Providers Cannot Charge You

The Law Is Absolute

Under 42 U.S.C. § 1396a(n)(3)(B) and 42 CFR § 447.15, Medicare providers and Medicare Advantage network providers are prohibited from balance billing QMB beneficiaries for Part A or Part B deductibles, coinsurance, or copayments. This protection applies in Montana under Administrative Rule ARM 37.85.406 as well.

The ban holds regardless of what Montana Medicaid actually pays on the crossover claim. Here's what happens behind the scenes:

  1. Your provider bills Medicare
  2. Medicare pays its share and crosses the remaining claim to Montana DPHHS
  3. DPHHS applies a "lesser-of" calculation — Medicaid pays the difference between the Medicare payment and Montana's Medicaid fee schedule rate
  4. If Medicare already paid more than the Medicaid rate, DPHHS pays $0 on the crossover

Even when Medicaid pays zero, the provider must write off the balance. They cannot send you a bill for the deductible, coinsurance, or copayment. Period.

Why the Bills Keep Coming

Automated billing systems don't know you're on QMB. When Medicare's crossover payment comes back at $0 from Medicaid, the system generates a patient responsibility statement for the unpaid balance. This isn't malice — it's software doing what software does.

The result: QMB beneficiaries across Montana regularly receive bills for amounts they don't owe. Some get sent to collections. The anxiety these bills create is real, but the legal protection is ironclad.

How to Stop an Improper Bill

Step 1: Confirm your QMB coverage dates. Check that the date of service falls within your active QMB coverage period. Your DPHHS approval notice lists the effective date.

Step 2: Call the provider's billing department. Give them your Medicare Beneficiary Identifier (MBI) and your Montana Medicaid ID number. Cite the federal law: 42 U.S.C. § 1396a(n)(3)(B) and 42 CFR § 447.15. Ask them to verify your QMB status with Medicaid and cancel the bill. Request written confirmation.

Step 3: Escalate if the provider won't budge. You have three escalation paths:

  • Call 1-800-MEDICARE (1-800-633-4227) and file a formal balance billing complaint. CMS tracks these complaints and can sanction repeat offenders.
  • Contact Montana SHIP at 1-800-551-3191 for advocacy assistance. SHIP counselors deal with these disputes regularly.
  • If a collection agency is involved, send a written dispute letter to the agency and keep a copy.

What About Medicare Advantage Plans?

The same billing protection applies. If your QMB beneficiary is enrolled in a Medicare Advantage plan, network providers cannot charge cost-sharing amounts. The MA plan's evidence of coverage doesn't override federal QMB protections.

Keep Records

Document every improper bill: the provider name, date of service, amount billed, date you called, who you spoke with, and the outcome. This log serves as evidence if you need to file a formal complaint or if the same provider bills you again.
