South Dakota QMB Billing Protection: What to Do When a Doctor Sends a Bill
Your parent has QMB approval from South Dakota DSS. The state pays their Medicare premiums and is supposed to cover deductibles and copays. Then a $283 bill for the Part B deductible shows up from their doctor's office, or a hospital sends a $1,736 invoice for the Part A deductible after a stay. Something went wrong — but not with their benefits.
The Federal Rule That Protects QMB Recipients
Federal law under 42 U.S.C. § 1396a(n)(3)(B) flatly prohibits Medicare providers from billing QMB beneficiaries for any Part A or Part B cost-sharing. That includes deductibles, copays, and coinsurance. South Dakota's own administrative rule ARSD 67:46:11:13 reinforces this.
The prohibition is absolute. It doesn't matter whether the provider participates in South Dakota Medicaid. It applies to original Medicare providers, Medicare Advantage network providers, and even out-of-state providers. If the patient has QMB, the provider cannot send them a bill for Medicare cost-sharing.
Why Bills Show Up Anyway
The mechanics create a gap that billing departments exploit — usually by mistake rather than intent.
When a QMB recipient gets a Medicare-covered service, the provider bills Medicare first. Medicare pays its share, leaving a balance (the copay or deductible). That remaining balance goes through South Dakota's Medicaid crossover system. South Dakota applies a "lesser-of" payment rule: if Medicaid's allowable fee for the service is at or below what Medicare already paid, DSS pays $0 in crossover reimbursement.
That $0 payment confuses billing offices. Staff see the zero-dollar state payment and assume the balance is the patient's responsibility. It isn't. A $0 state payment does not give the provider the right to bill the QMB recipient. The provider must write off the remaining balance.
Four Steps to Resolve an Improper Bill
Step 1: Present your QMB status. Show the provider's billing supervisor the DSS approval notice and the Medicare card. Point to the federal balance-billing rules printed on the back of Medicare Summary Notices (MSNs).
Step 2: Call 1-800-MEDICARE. Report a formal QMB balance-billing violation at 1-800-633-4227. CMS issues a compliance warning letter directly to the provider, ordering immediate billing cessation and refund of any improperly collected payments.
Step 3: Contact DSS Constituent Liaison Services. Call 1-800-597-1603 or email [email protected] to file an administrative complaint. DSS can intervene with the provider at the state level.
Step 4: Get legal aid if collections escalate. If a billing department sends the account to a collection agency or files suit, contact East River Legal Services (1-800-952-3015) for eastern South Dakota counties or Dakota Plains Legal Services (1-800-658-2297) for western South Dakota and tribal areas.

What QMB Doesn't Protect Against
QMB billing protections cover Medicare-covered services only. Non-covered services — such as cosmetic procedures or services Medicare has denied as not medically necessary — are not subject to the balance billing prohibition. If Medicare doesn't cover the service at all, the provider can bill the patient.
SLMB and QI enrollees do not receive the same billing protections. Those tiers cover only the Part B premium; they don't extend to deductibles, copays, or coinsurance. QMB is the tier that eliminates all Medicare cost-sharing.
Keep Records
Every conversation with a billing office should be documented: the date, the name of the person you spoke with, what was discussed, and the outcome. If the provider agrees to write off the balance, get that confirmation in writing. Verbal promises from front-desk staff can disappear when the next billing cycle runs.
The South Dakota Medicare Savings Programs & Extra Help Guide includes a billing dispute log and step-by-step instructions for asserting QMB protections at each level — from the provider's billing office to the CMS compliance process.
