Nebraska Medicare Savings Program Denial and Appeal Process

A denial letter from Nebraska DHHS feels final. It isn't. You have 90 days to request a fair hearing, and if you act within 10 days, your existing benefits stay active while the appeal is pending. Most MSP denials stem from fixable problems — miscounted income, missing documents, or asset calculations that used the wrong threshold.

Common Reasons for Denial

Excess resources: Bank balances above $9,950 (single) or $14,910 (couple) on the first day of the month. A common mistake: families assume the standard Medicaid asset limit of $4,000/$6,000 applies. It doesn't — MSP uses the higher federal MIPPA limits.

Procedural closure: DHHS requested verification documents and didn't receive them within the 10-to-14-day window. This isn't a true eligibility denial — it's a paperwork failure. You can resubmit immediately.

Income over threshold: The eligibility worker calculated income differently than you expected. The most frequent error: the applicant compared net deposit to the QMB limit instead of gross Social Security, or forgot that the $20 disregard is already built into the published thresholds.

Immigration criteria: Non-citizens must meet qualified non-citizen status, and most lawful permanent residents face a 5-year waiting period unless exempt as refugees, asylees, or military veterans.

The Fair Hearing Process

Under Title 477 NAC Chapter 10, you have 90 calendar days from the date on the denial notice to file a Request for Fair Hearing. File in writing or verbally:

  • Written: Mail or fax to Nebraska DHHS Legal Services / Hearing Office, P.O. Box 98914, Lincoln, NE 68509-8914. Fax: (402) 471-9328.
  • Verbal: Call DHHS Medicaid Customer Service at (855) 632-7633 and state your intent to appeal.

The 10-Day Benefit Continuation Rule

If DHHS is terminating existing MSP benefits, you have 10 calendar days from the notice date to file a fair hearing request and keep your current benefits running through the appeal. After 10 days, you can still file (within the 90-day window), but benefits stop while you wait.

One risk: if the hearing officer upholds the DHHS decision, Nebraska can recover the cost of premiums paid during the appeal period.

Your Rights at the Hearing

You can inspect your DHHS case file before the hearing. You can present witnesses, submit additional documentation, cross-examine the state eligibility worker, and bring legal counsel. Hearings are conducted by an independent hearing officer, not by the same worker who denied your case.

Free Legal Help

  • Legal Aid of Nebraska: (888) 998-6570 or Elder Access Line at (800) 527-7249
  • Nebraska SHIIP: 1-800-234-7119 for administrative advocacy

Legal Aid may be able to assist eligible low-income seniors with MSP fair hearings. Call as soon as you receive the denial notice to ask what help is available — don't wait until the hearing date.

The 90-Day Reconsideration Alternative

If your MSP was terminated (not an initial denial), Nebraska gives you a 90-day post-closure window to submit updated documentation and request reconsideration without filing a brand-new application. This is faster than a fair hearing when the issue was missing paperwork rather than a true eligibility dispute.
