Missouri Medicare Savings Program Denial and Appeal Process
Common Reasons for Denial
FSD denies Medicare Savings Program applications for a few recurring reasons:
Income over the limit. FSD calculated your countable income above the program tier's ceiling. This often happens because of how gross income is computed — FSD uses your gross Social Security benefit (before Part B premium deductions), not the net deposit you see in your bank account.
Resources over the limit. Bank balances, non-exempt retirement accounts, or a second vehicle's equity pushed total countable resources above $9,660 (individual) or $14,470 (couple).
Missing documentation. FSD requested verification documents and didn't receive them within the required timeframe. Incomplete bank statements (missing pages) are a frequent trigger.
Citizenship or residency issue. The SAVE system data match or SSA exchange flagged an unresolved citizenship or immigration status question.
Your Right to a Fair Hearing
Under Missouri administrative regulations (13 CSR 40-2.440), you have the right to request a fair hearing within 90 calendar days of the denial notice. The hearing is conducted by the Missouri Department of Social Services.
To request a hearing:
- Call 855-373-4636
- Submit a written request to your local FSD Resource Center
- Email the DSS Division of Legal Services Hearings Unit
You do not need an attorney, though free legal assistance is available through Missouri Legal Services and Legal Aid of Western Missouri if your case is complex.
Aid Continuing: Keeping Benefits While You Appeal
If you're being terminated from an existing MSP enrollment (not denied on an initial application), you can request "aid continuing" — also called "aid paid pending" — by filing your hearing request within 10 calendar days of the notice date.
This means your QMB, SLMB, or QI-1 coverage remains active while the appeal is processed. To preserve benefits while appealing, request the hearing within 10 calendar days of the notice date.
For initial application denials, there's no existing coverage to continue. But the appeal process can still reverse the decision if FSD made an error in the eligibility calculation.

Preparing for the Hearing
The hearing officer reviews FSD's determination against the evidence. Bring:
- The denial or termination notice (it states the specific reason and the regulation FSD cited)
- Your own income calculations showing gross Social Security, the $20 disregard, and countable income
- Bank statements and asset documentation that FSD may have miscounted
- Any correspondence with FSD — submission confirmations, fax receipts, upload confirmations from myDSS
If the denial was for excess income, check whether FSD correctly applied the $20 unearned income disregard. If the denial came during January–March, check whether the COLA disregard was properly applied (Social Security COLA increases are excluded from income calculations during Q1 until updated poverty guidelines take effect in April).
If the denial was for excess resources, verify that FSD correctly excluded your home, primary vehicle, burial provisions, and term life insurance. Joint account presumptions — FSD assuming 100% of a joint account belongs to the applicant — are a common dispute point.
After the Hearing
After the hearing, the DSS Director issues the final administrative decision. If it is in your favor, FSD must implement it.
If the decision goes against you, you can seek judicial review in Circuit Court within 30 days of the Director's decision.
