How to Appeal a Virginia Medicare Savings Program Denial

The 30-Day Deadline (and How to Calculate It)

When your local DSS denies or terminates Medicare Savings Program coverage, they send a Notice of Action. You have 30 calendar days from the date you receive that notice to file an appeal with the DMAS Appeals Division.

Virginia law presumes you received the notice 5 calendar days after it was mailed. So the actual calculation is:

  • Notice mailed: October 1
  • Presumed receipt: October 6
  • Appeal deadline: November 5

That 30-day window is strict. Attempting to resolve the issue informally with your local DSS caseworker — which you should try — does not pause or extend the deadline. If informal talks stall, file the appeal anyway and continue the conversation in parallel.

Where to File

The DMAS Appeals Division accepts appeals through multiple channels:

  • Online: DMAS Appeals Information Management System (AIMS) at dmas.virginia.gov/#/appealsresources
  • Email: [email protected]
  • Fax: (804) 452-5454
  • Phone: (804) 371-8488
  • Mail: Appeals Division, DMAS, 600 E. Broad Street, Suite 1300, Richmond, VA 23219

Use whatever channel gets the appeal filed fastest. Email and the online portal give you a timestamp; mail works but leaves less margin if you're close to the deadline.

How to Keep Benefits Running During the Appeal

If you're an existing MSP enrollee facing termination (not a first-time applicant), you can maintain uninterrupted coverage through the appeal by filing on or before the effective date of the termination. The effective date is stated on the Notice of Action; use the date shown there.

If the appeal is filed after the effective date, benefits stop while the appeal is pending. This distinction matters enormously: losing QMB coverage mid-appeal means Part B premiums resume, billing protections disappear, and reinstating everything after a favorable ruling takes weeks.

What Happens at the Hearing

DMAS conducts evidentiary fair hearings, typically by phone or video conference. A hearing officer reviews:

  • The DSS case file, including the eligibility calculation
  • Your documentation and arguments
  • Applicable DMAS Eligibility Manual provisions

You can present your own evidence — bank statements showing resources were miscounted, proof that a retroactive Social Security payment falls within the 9-month resource exclusion, documentation that income was calculated using net rather than gross, or evidence that a disregard wasn't applied.

An authorized representative (filed via Appendix C) or an attorney can attend on your behalf. VICAP counselors can help prepare your case, and the Virginia Poverty Law Center's Senior Legal Helpline (844-802-5910) provides free legal advice for Virginians 60 and older.

Common Denial Reasons Worth Appealing

Gross vs. net income error. The caseworker used the net Social Security deposit instead of the gross benefit amount — the amount before Part B premiums, tax withholding, or garnishments are deducted. If the gross amount was used correctly but you believe a disregard was missed — the $20 general disregard, an earned income exclusion, or a VA benefit exclusion — that's worth challenging.

Resource miscalculation. Joint accounts presumed entirely owned by the applicant, retirement accounts in active payout status counted as lump-sum resources, or a retroactive Social Security payment counted as a resource within its 9-month exclusion period.

Failure to evaluate for a higher tier. If your income exceeds QMB limits but falls within SLMB or QI range, the caseworker should have evaluated eligibility for those programs rather than simply denying QMB. A denial letter that doesn't address alternative MSP tiers may reflect an incomplete determination.

The Virginia Medicare Savings Programs & Extra Help Guide includes an appeal timeline tracker and a notice decoder that maps the codes on Virginia's Notice of Action to the specific eligibility manual provisions cited in the denial.
