Maine Medicare Savings Program Denial — How to Appeal

The Denial Notice Tells You Exactly Why

When OFI denies an MSP application or terminates existing coverage, the notice must identify the specific factual and legal basis — typically that countable income exceeds the program ceiling, or that a verification document wasn't returned by the deadline. The notice also cites the applicable MaineCare Eligibility Manual rules and provides instructions for requesting a fair hearing.

Read the notice carefully before deciding what to do next. Common denial reasons and their fixes:

  • Income over the limit: Check whether OFI applied the correct disregards ($20 unearned, $65 + 50% earned). If they used gross income without disregards, that's an error worth appealing.
  • Missing documents: If you submitted verification but OFI didn't receive it (fax failures are common), resubmit with proof of delivery.
  • Medicare entitlement not confirmed: If SSA hasn't confirmed Medicare enrollment electronically, OFI may deny. Provide the Medicare card and request reprocessing.

How the Fair Hearing Process Works

Maine DHHS's Division of Administrative Hearings conducts fair hearings. You have the right to request a hearing if your MSP application is denied, your benefits are reduced, or your coverage is terminated.

Filing the request: Follow the instructions in the notice to submit a written hearing request. It must be postmarked or delivered within 60 calendar days from the date printed on the notice. If an existing MSP recipient files within 10 calendar days of the notice date, or before the effective date of closure, coverage must be maintained at existing levels pending the hearing decision (aid-paid-pending).

The hearing itself: An impartial hearing officer reviews the case. You can present evidence, bring witnesses, and have a representative (including an adult child or legal aid attorney) speak on your behalf. Hearings can be conducted by phone.

The decision: The hearing officer issues a written decision. If you prevail, review it for the coverage result and effective date.

Renewals — What to Expect

MSP coverage requires annual redetermination. OFI first attempts an ex parte renewal — automated data checks against SSA records, state wage databases, and tax filings. If everything verifies within program thresholds, coverage renews automatically without any action from the enrollee.

If the automated check fails, OFI mails a prepopulated renewal form. The enrollee has 30 calendar days to review it, correct any errors, sign it, and return it with any requested income verification.

Missing the 30-day deadline triggers coverage closure. But there's a 90-day reconsideration window: if the completed renewal packet arrives within 90 days of closure, OFI must process it without requiring a brand-new application.

When to Get Legal Help

For straightforward denials — a calculation error, a missing document — you can often resolve the issue by resubmitting or requesting a fair hearing yourself. For more complex situations, free legal assistance is available:

  • Legal Services for Maine Elders: 1-800-750-5353 — represents low-income seniors in benefit disputes
  • Pine Tree Legal Assistance: Handles MaineCare eligibility appeals statewide
  • Maine Equal Justice: Policy advocacy and individual case support

These organizations prioritize active terminations and denials over routine application help, so they're most useful when coverage is at stake.

Don't Let a Denial Stop You

A denial isn't necessarily the final answer. Income calculations use disregards that OFI sometimes misapplies. Documents sometimes don't arrive. Circumstances change month to month — a temporary spike in pension income or a one-time lump sum (which counts only in the month received) might push someone over the limit in one month but not the next.

The Maine Medicare Savings Programs guide includes a renewal calendar, evidence preparation templates, and the full fair hearing timeline — everything needed to challenge a denial or manage renewals without missing a deadline.
