IHSS SOC 839 Form: How to Become Your Parent's Authorized IHSS Representative

Your parent has been approved for In-Home Supportive Services. You have a notarized power of attorney. And the county social worker just told you that you still can't manage your parent's IHSS case.

This trips up nearly every California family. IHSS operates under the California Department of Social Services, and it requires its own specific authorization forms — a general Durable Financial Power of Attorney doesn't give you the authority to communicate with IHSS workers, attend assessments on your parent's behalf, or sign timesheets.

What Form SOC 839 Does

Form SOC 839 (Designation of Authorized Representative) allows you to act as your parent's representative in all IHSS-related matters. Once filed with the county social services department, you can:

• Communicate with the assigned IHSS social worker about your parent's case
• Attend the in-home assessment where hours are determined
• Request reassessments if your parent's condition changes
• File appeals if hours are reduced or denied
• Receive notices about your parent's IHSS eligibility and authorized hours

The form must be signed by the IHSS recipient (your parent) or by someone with legal authority to act on their behalf. If your parent has capacity, they sign directly. If they lack capacity and you have a valid DPOA or conservatorship, you sign in that capacity with the legal document attached.

Form SOC 839A: The Timesheet Form

If you also need to sign your parent's provider timesheets — because they can't physically sign or lack the cognitive ability to verify hours — you'll need the companion form SOC 839A (Designation of Signatory for Timesheets and Other Provider-Related Documents).

This is a separate designation. SOC 839 alone does not authorize you to sign timesheets. Both forms should be submitted together if your parent needs full representation.

Without SOC 839A, the paid caregiver (even if that's you or another family member) cannot submit timesheets for payment, which means the caregiver doesn't get paid until the paperwork is resolved.

How to File

1. Get the forms. Your county IHSS office provides Forms SOC 839 and SOC 839A. They're also available from the California Department of Social Services website.

2. Complete the designation. Fill in your parent's information, your information, and the scope of representation.

3. Sign the forms. Your parent signs (or you sign as their legal agent, attaching the POA or court order).

4. Submit to the county. File with the IHSS office that handles your parent's case. Keep copies for your records.

5. Confirm receipt. Follow up within two weeks to confirm the designation is on file. The county should update your parent's case record so the assigned social worker knows to communicate with you.

Why the County Can't Require a Conservatorship

Some families report being told by county IHSS workers that they need a conservatorship to represent their parent. This is incorrect. Under California policy, the county cannot require a family to seek a conservatorship in order to process an IHSS application or manage an existing case if an authorized representative has been properly designated using SOC 839.

If you encounter this, cite the SOC 839 form itself and request to speak with a supervisor. The form exists specifically to avoid unnecessary conservatorship proceedings.

Other Forms You May Need

IHSS authorization is just one piece. If your parent receives Medi-Cal (which funds IHSS), you'll also need:

• Form MC 306 (Appointment of Representative) for Medi-Cal eligibility communication — renewals, notices, fair hearings
• Durable Financial Power of Attorney for banking, property, and general financial management
• Advance Health Care Directive for medical decision-making

Each system — IHSS, Medi-Cal, Social Security, healthcare — requires its own authorization. No single document covers all of them.

Timing Matters

If your parent's IHSS assessment is coming up and you haven't filed SOC 839, you may not be allowed to participate in the assessment. The county social worker will speak directly to your parent — who may not be able to accurately describe their needs or advocate for the right number of hours.

File SOC 839 as soon as your parent is approved for IHSS (or as soon as you start the application process). Getting it on file early means you're the point of contact for everything that follows.
