West Virginia QMB Balance Billing Protections: What Doctors Can't Charge You
The Federal Law That Protects You
Under 42 U.S.C. § 1396a(a)(25)(B), 42 U.S.C. § 1396b(n), and 42 C.F.R. § 447.15, every Medicare-enrolled provider in the country is prohibited from billing QMB enrollees for Medicare Part A and Part B cost-sharing. That means:
- No Part A deductible ($1,736 per benefit period in 2026)
- No Part B deductible ($283 annually)
- No coinsurance (the 20% you'd normally owe after the deductible)
- No copays for Medicare-covered services
This ban applies to all Medicare providers nationwide — not just West Virginia providers, and not just providers who accept Medicaid. It applies whether you're on Original Medicare or a Medicare Advantage plan. Your financial liability for Medicare cost-sharing is $0.
Why Providers Bill You Anyway
West Virginia's Bureau for Medical Services reimburses providers for QMB cost-sharing using a "lesser-of" payment methodology. In practice, this often means the state pays less than what the provider would have collected from the patient, and sometimes the state payment rounds to zero.
Providers see that zero payment and assume they can collect from you instead. They can't. Even when Medicaid pays nothing on the crossover claim, the provider must accept Medicare's primary payment as payment in full. The law doesn't say "providers get paid twice" — it says you owe nothing.
Some billing departments genuinely don't know the rule. Others know it and bill anyway, hoping patients will pay rather than fight. Either way, you don't owe the money.
How to Stop an Improper Bill
Follow this sequence:
Step 1 — Written dispute to the provider. Send a letter to the billing department. Include a copy of your DoHS QMB approval notice and the Medicare Summary Notice (MSN) for the service in question. State that you're enrolled in QMB and that federal law prohibits balance billing QMB beneficiaries for Medicare cost-sharing. Keep a copy.
Step 2 — Call 1-800-MEDICARE. If the provider doesn't back down, call 1-800-633-4227. CMS customer service will log the balance billing violation and send an official compliance letter to the provider instructing them to stop billing and refund any money already collected.
Step 3 — Escalate if it goes to collections. A provider who sends a QMB balance bill to a collection agency is violating federal law. Contact Legal Aid of West Virginia at 1-866-255-4370 or WV SHIP at 1-877-987-4463. Legal Aid can send formal legal notice and halt the debt collection.

What About Medicare Advantage Plans?
QMB billing protections apply identically to Medicare Advantage. If your MA plan's EOB shows a copay or coinsurance amount, that amount should be written off by the provider — not billed to you. Some MA plans handle this automatically by showing $0 cost-sharing for QMB members. Others generate standard EOBs that confuse both the provider and the patient.
If you're getting balance bills through a Medicare Advantage plan, call the plan's member services line and ask them to update your file to reflect QMB status.
Pharmacy Copays Are Different
QMB's billing ban covers Medicare Part A and Part B cost-sharing. Part D prescription drug copays work through a separate mechanism — Extra Help (the Low-Income Subsidy). If you have QMB, you're automatically deemed eligible for full Extra Help, which caps your prescription copays at $5.10 for generics and $12.65 for brand-name drugs.
If a pharmacy charges you more than these amounts, present your DoHS approval notice as Best Available Evidence (BAE). The Part D plan must update your file within 48 to 72 hours, clear the incorrect charges, and reimburse any overpayment.
