Virginia QMB Billing Protection: What to Do When a Doctor Bills You
The Rule Is Absolute
Under 42 U.S.C. § 1395cc(a)(1)(A)(i) and § 1396a(n)(3)(B), Medicare-enrolled providers are prohibited from billing QMB beneficiaries for any Medicare Part A or Part B cost-sharing — deductibles, coinsurance, and copays. No exceptions.
This applies even when:
- Virginia Medicaid pays $0 toward the cost-sharing amount (which happens when Medicare's payment already meets or exceeds Virginia's Medicaid rate for that service)
- The provider is not enrolled as a Virginia Medicaid/Cardinal Care participating provider
- The provider's billing system sends the bill automatically
The provider must write off the remaining balance. Sending a bill, sending it to collections, or refusing future care over an unpaid QMB cost-sharing balance violates the provider's Medicare participation agreement.
Why It Keeps Happening
Most improper QMB billing isn't deliberate. Automated medical billing systems generate bills for any unpaid cost-sharing amount without checking QMB status. Front-desk staff at small practices may not know what QMB means. And when Virginia Medicaid pays $0 on a crossover claim (because Medicare already paid the full Medicaid-allowed amount), the billing system sees an unpaid balance and sends a statement.
The result: a QMB beneficiary gets a bill for $200 in Medicare coinsurance they don't owe, panics, and either pays it or avoids future appointments.
How to Stop It
Step 1: Call the billing office. Identify the practice's billing department and explain that the patient has QMB coverage. Reference the federal prohibition — 42 U.S.C. § 1395cc(a)(1)(A)(i). Ask them to check the patient's Medicare Summary Notice, which will show QMB status. Request that the balance be written off and any collection activity stopped.
Step 2: File a complaint with 1-800-MEDICARE. If the billing office refuses to correct the bill, call 1-800-633-4227 and report the QMB billing problem. CMS can refer the complaint to its Medicare contractor, which may send the provider a compliance letter and request a refund.
Step 3: Escalate in Virginia. Contact VICAP (your local Area Agency on Aging) for help navigating the dispute. The Virginia Senior Medicare Patrol can help with Medicare billing problems at 1-800-938-8885. For bills already in collections or if the provider threatens to refuse care, contact the Virginia Poverty Law Center's Senior Legal Helpline at 844-802-5910.

What QMB Billing Protection Does Not Cover
The protection applies to Medicare-covered services only. Services that Medicare doesn't cover — routine dental, most vision care, hearing aids under Original Medicare — remain the beneficiary's responsibility unless covered by full Medicaid.
If the beneficiary has both QMB and full Medicaid (a "full-benefit dual eligible"), additional services may be covered through Virginia's Medicaid program. But QMB alone covers Medicare cost-sharing, not non-Medicare services.
Keep Proof Accessible
The single most effective defense is having a copy of the MSP approval letter from Virginia DSS readily available. When a billing office sees the official state approval showing QMB status and the effective date, most correct the bill immediately. Store a copy digitally on a phone and keep a paper copy with insurance cards.
