QMB Balance Billing Protection in Kentucky: Your Rights When a Doctor Bills You
The Federal Rule Is Absolute
Under 42 CFR § 447.15, no Medicare-enrolled provider may bill a Qualified Medicare Beneficiary for Medicare Part A deductibles, Part B coinsurance, or copayments. Period. This applies to every provider who accepts Medicare — regardless of whether they also participate in Kentucky Medicaid.
The provider must accept the Medicare-approved amount plus any state Medicaid payment as payment in full. They cannot bill the QMB patient for the remaining balance or send that balance to collections.
This protection exists because QMB's entire purpose is to cover Medicare cost-sharing for low-income beneficiaries. A provider billing a QMB patient for the very costs the program covers defeats the federal benefit.
Why Bills Show Up Anyway
If the protection is this clear, why do QMB beneficiaries in Kentucky still receive bills for Medicare deductibles and coinsurance?
Billing software automation. Hospital and physician billing systems generate balance bills based on Medicare's Explanation of Benefits, which shows a patient responsibility amount. The software doesn't check QMB status before printing the bill — it just follows the standard billing cycle.
Provider staff unfamiliarity. Many front-desk and billing staff don't know what QMB is. They see a Medicare patient with a balance and follow their standard collection procedures.
Crossover claim delays. After Medicare pays its share, the remaining amount is supposed to "cross over" to Kentucky Medicaid for payment. If the crossover claim is delayed or rejected, the provider's system flags the patient balance as unpaid and generates a bill.
What to Do When You Get a Balance Bill
If you or your parent receives a bill for Medicare deductibles or coinsurance while enrolled in QMB:
Step 1: Confirm active QMB status. Check your Medicaid card or call the kynect helpline at 1-855-459-6328 to verify that QMB coverage is active and current.
Step 2: Contact the provider's billing department. Tell them you are enrolled in QMB (Qualified Medicare Beneficiary) and that federal law at 42 CFR § 447.15 prohibits balance billing QMB patients for Medicare cost-sharing. Ask them to write off the balance and submit any remaining claims as a Medicaid crossover.
Step 3: Put it in writing. If the billing department doesn't resolve it after a phone call, send a written cease-and-desist letter. Include your name, date of birth, Medicaid ID number, the QMB federal prohibition citation, and a request that the bill be withdrawn and the account removed from collections.
Step 4: Escalate if needed. If the provider continues billing, call 1-800-MEDICARE at 1-800-633-4227 and Kentucky Medicaid Member Services at 1-855-459-6328 to report the balance billing.

Prevention Is Easier Than Correction
Carry your Kentucky Medicaid card alongside your Medicare card at every appointment. When checking in, tell the receptionist you have QMB coverage so the billing system can flag your account before claims are processed. If you're seeing a new provider, verify upfront that they'll process the Medicaid crossover.
