Arkansas QMB Balance Billing: Your Rights When a Doctor Bills You
The Law Is Clear: QMB Enrollees Cannot Be Balance Billed
Federal law under 42 U.S.C. 1396a(n)(3) prohibits Medicare providers from billing QMB beneficiaries for any Medicare Part A or Part B cost-sharing. That means deductibles, coinsurance, and copayments — all of them. This applies whether your parent has Original Medicare or a Medicare Advantage plan.
The protection is absolute. It doesn't matter if Arkansas Medicaid pays the provider nothing on the secondary claim (which often happens under the state's "lesser-of" payment policy). The provider must write off the balance. They accepted this obligation when they enrolled in Medicare.
Why Providers Bill Anyway
Despite the federal prohibition, improper billing happens regularly. Common reasons:
- The provider's billing system doesn't flag QMB status correctly
- Staff aren't trained on QMB protections and treat every Medicaid crossover as a regular secondary claim
- Collection agencies pursue old balances without checking program enrollment
- The provider knows the law but counts on patients not knowing it
Bills arriving for Medicare deductibles ($1,736 for a hospital stay, $283 for Part B) or 20% coinsurance can look legitimate. They're not — as long as your parent had QMB on the date of service.
How to Dispute an Improper Bill
Follow this escalation sequence:
Step 1 — Contact the billing office. State clearly: "The patient is enrolled in the Qualified Medicare Beneficiary program under Arkansas Medicaid. Under federal law at 42 U.S.C. 1396a(n)(3), Medicare providers cannot bill QMB enrollees for Medicare deductibles or coinsurance." Provide the Arkansas Medicaid ID number and offer a copy of the DCO-700 approval notice.
Step 2 — Show the Medicare Summary Notice. Original Medicare MSNs print a direct warning on claims statements indicating the beneficiary cannot be billed for copayments. Forward a copy to the provider.
Step 3 — Call 1-800-MEDICARE. If the provider refuses to adjust the bill or threatens collections, call 1-800-633-4227. CMS can confirm QMB status and ask the provider to stop billing and refund any amounts you have already paid.
Step 4 — Contact Arkansas SHIIP or Legal Aid. For persistent billing issues, reach SHIIP at 1-800-224-6330 or Legal Aid of Arkansas at 1-800-952-9243. Legal Aid can intervene directly on your parent's behalf.

What QMB Billing Protections Don't Cover
The prohibition applies strictly to Medicare-covered services from Medicare-enrolled providers. It does not protect against:
- Services Medicare doesn't cover (routine dental, cosmetic procedures, non-covered personal care)
- Care from providers who have formally opted out of Medicare and signed a private contract
- Bills for services received before QMB coverage started
If a bill is for a service that isn't covered by Medicare at all, QMB protections don't apply, and your parent may legitimately owe the charge.
