QCAT and SAT Guardianship Applications in Queensland and Western Australia
Queensland and Western Australia each have their own tribunal for guardianship and administration matters — QCAT (Queensland Civil and Administrative Tribunal) and SAT (State Administrative Tribunal). Both are free to file, but the ongoing costs after an order is made differ substantially between the two states.
Queensland: QCAT Guardianship Application
When to Apply
An application to QCAT's Human Rights Division is necessary when a person in Queensland has lost decision-making capacity and there's no enduring power of attorney in place. Common triggers include bank account lockouts, aged-care placement disputes, property sales needed to fund care, and medical treatment decisions where the family can't agree.
The QCAT Process
Filing. The application is made using QCAT forms — typically involving Form 10 (Application for Guardianship and/or Administration). Filing is free ($0). Any person with a genuine interest in the person's welfare can apply.
Medical evidence. QCAT requires a Health Professional Report completed under the Guardianship and Administration Act 2000. The report must be from the person's treating doctor, a geriatrician, or a neuropsychologist, and must specifically address whether the person has impaired capacity for the type of decisions in question. The research says reports are usually less than three months old; check QCAT's current requirements before filing.
The report must address the four-part functional capacity test used across Australia: can the person understand the relevant information, retain it, weigh the consequences, and communicate a choice?
Hearing. Standard QCAT guardianship matters can take weeks. Urgent applications (imminent financial harm, critical medical decisions) can be heard faster. Hearings are informal — the tribunal member actively questions the applicant and other interested parties rather than relying on formal evidence presentation.
What QCAT Can Order
Guardianship order — appoints a guardian for personal and medical decisions. In Queensland, this is particularly relevant because a QLD EPOA can cover both financial and personal/health matters — so a family that missed the window for an EPOA misses both types of authority in one go.
Administration order — appoints an administrator for financial decisions. The administrator manages bank accounts, pays bills, and handles property transactions.
Interim order — if an urgent decision can't wait for the full hearing, QCAT may make a temporary order; its scope and duration depend on the order and the circumstances.
The Cost of Public Trustee Administration in QLD
If QCAT appoints the Queensland Public Trustee as administrator, the costs are among the highest in Australia. The Public Trustee charges annual management fees of approximately 5%–6% of the managed estate's gross value. For a parent with a home worth $800,000 and $200,000 in savings, that's $50,000–$60,000 per year in management fees alone.
This fee structure means families who let the EPOA window close — who don't set up enduring documents while their parent has capacity — face a significant ongoing financial penalty when the state steps in.
Western Australia: SAT Guardianship Application
When to Apply
SAT's Guardianship and Administration division handles applications under the Guardianship and Administration Act 1990. The triggers are the same as in other states: capacity has been lost, no enduring documents exist, and a decision needs to be made that requires formal legal authority.
WA's system requires two separate enduring instruments — the Enduring Power of Attorney for financial decisions and the Enduring Power of Guardianship for personal and medical decisions — so families that miss the capacity window may need both a guardianship and an administration order from SAT.
The SAT Process
Filing. Applications are submitted to SAT using the standard guardianship application form. Filing is free ($0).
Medical evidence. SAT requires either a Medical Report or a Service Provider Report confirming the person's incapacity. The report must come from a treating health professional and address the person's cognitive impairment, its effect on their decision-making, and whether the impairment is expected to be permanent or temporary.
Hearing. Standard SAT matters can take weeks. The tribunal can convene earlier for urgent applications. As with QCAT, the hearings are informal and family members can represent themselves.
The WA Audit Cost Trap
Western Australia has a unique ongoing cost that catches private administrators off guard. When SAT appoints a family member as administrator (rather than the Public Trustee), that family member must submit annual accounts detailing every financial transaction made on the person's behalf.
Those annual accounts are examined by the WA Public Trustee, and the examination fee is $354 per hour with a minimum charge of $354. The total depends on the complexity of the accounts, property transactions, and aged-care payments. This is a recurring cost for the administration order — not a one-off fee.
This audit requirement makes WA one of the most expensive states for tribunal-ordered financial administration, even when a family member is appointed rather than the state.
Emergency and Temporary Orders
Both QCAT and SAT can make emergency orders when there's an immediate risk:
- Financial exploitation of a vulnerable person
- A parent about to be discharged from hospital with no safe accommodation
- An aged-care facility requiring someone to sign a resident agreement before they'll accept the placement
- Urgent medical treatment decisions where the family is in conflict
Emergency guardianship orders are typically limited in duration and scope — the order only covers the specific decisions that are urgent, not broad management of the person's affairs. The exact period depends on the jurisdiction and order.
