You have been bathing, dressing, and feeding your parent for two years without compensation. Alabama has a program that can pay you for this work — and your parent can stay home instead of entering a nursing facility.

The Personal Choices Program is a self-directed care option within Alabama's Medicaid HCBS waivers. It allows enrolled participants to hire their own caregivers, including spouses and adult children, and pay them with Medicaid funds.

How Personal Choices Works

Under the standard HCBS waiver model, care is delivered by an agency — a home health company sends workers to the participant's home on a set schedule. The Personal Choices Program flips this: the participant receives an individual budget and manages it themselves.

The participant (or their authorized representative) acts as the legal employer. They recruit, hire, schedule, supervise, and if necessary fire their own caregivers. This can include family members — adult children, spouses, siblings, or other relatives.

Payment is processed through a fiscal management agency (FMA), which handles payroll, tax withholding, workers' compensation, and compliance. The caregiver does not receive cash directly from the participant; the FMA issues paychecks based on approved hours.

Pay Rates and Hours

Caregiver pay rates under Personal Choices average approximately $12.66 per hour in Alabama, administered through the fiscal management agency. The exact rate can vary by region and the specific services provided.

The number of approved hours depends on the participant's care plan assessment. A participant assessed as needing full-time assistance may receive 30 to 40 hours per week; someone needing less may receive 10 to 15 hours. Hours are set during the initial care plan development and adjusted during annual reviews.

Which Waivers Offer Personal Choices

Two Alabama Medicaid waivers include the Personal Choices option:

Elderly and Disabled (E&D) Waiver: The primary waiver for seniors aged 65 and older and adults with physical disabilities. Managed by the Alabama Department of Senior Services (ADSS) through the state's 13 regional Area Agencies on Aging. Services include personal care, homemaker services, respite care, adult day health, and companion services. Financial eligibility: income below $2,982 per month, assets below $2,000.

SAIL Waiver (State of Alabama Independent Living): For adults aged 18 and older with severe physical disabilities whose onset occurred before age 63. Managed by the Alabama Department of Rehabilitation Services (ADRS). Covers assistive technology, home modifications, specialized personal care, and transitional services. Same financial eligibility thresholds.

Both waivers require the participant to meet nursing facility level of care — meaning the person must need the kind of care that would otherwise be provided in a nursing home. This is assessed through a clinical evaluation.

Enrollment Steps

  1. Contact your regional Area Agency on Aging at 1-800-243-5463 (for the E&D Waiver) or the Alabama Department of Rehabilitation Services (for the SAIL Waiver) to request an eligibility screening

  2. Complete the financial application — the same income and asset limits apply as for nursing home Medicaid ($2,982 monthly income cap, $2,000 asset limit). A Miller Trust is required if income exceeds the cap

  3. Undergo a clinical assessment — a nurse reviewer evaluates the participant's functional limitations to determine nursing facility level of care

  4. Develop a care plan — once approved, a case manager works with the participant to create a person-centered care plan that specifies services, hours, and budget

  5. Opt into Personal Choices — during care plan development, the participant elects self-direction and identifies their chosen caregivers

  6. Fiscal management enrollment — the caregivers complete employment paperwork (W-4, I-9, background check) through the fiscal management agency

The Waitlist Reality

Unlike institutional Medicaid (nursing home), which is a federal entitlement with no waitlist, HCBS waivers are capped-slot programs. The E&D Waiver has approximately 15,000 slots statewide, and when they are filled, new applicants go on a referral list.

In practice, the E&D Waiver does not maintain a traditional waitlist — eligibility is verified when a slot becomes available, not at the time of initial referral. Wait times vary by region and can range from weeks to several months depending on local demand and turnover.

Requirements for Family Caregivers

Family members hired through Personal Choices must:

  • Pass a background check
  • Complete required training (typically orientation through the fiscal management agency)
  • Track and report hours accurately
  • Provide care according to the approved care plan
  • Not be the participant's authorized representative and caregiver simultaneously (these roles must be held by different people if a representative is needed)

There is no professional license or certification requirement for family caregivers under Personal Choices. The program is specifically designed to formalize and compensate the informal caregiving that family members already provide.
