Oklahoma DHS Fair Hearing Medicare
When to File a Fair Hearing
An OKDHS fair hearing is your legal right whenever the agency denies your Medicare Savings Program application, reduces your benefits, or closes your case. You have 30 calendar days from the date on the Notice of Decision to file. For an existing enrollee facing a reduction or closure, the separate 10-day deadline preserves benefits while the appeal is processed.
The most common triggers for MSP appeals in Oklahoma:
- Income calculated incorrectly. OKDHS failed to apply the $20 monthly unearned income disregard, miscounted a pension, or didn't drop the cents from the BENDEX Social Security figure.
- Assets misclassified. Joint bank accounts attributed 100% to the applicant instead of recognizing the co-owner's contributions. Irrevocable burial contracts counted as liquid assets. Exempt property treated as countable.
- Procedural closure. The case was closed because bank statements arrived late — but the delay was the bank's fault, not yours.
- MSP confused with full Medicaid. The caseworker applied traditional SoonerCare income limits instead of the higher MSP thresholds.
The 10-Day Aid-Paid-Pending Rule
If you're already enrolled in QMB, SLMB, or QI-1 and OKDHS sends a notice saying your benefits are being reduced or terminated, filing your hearing request within 10 days of the notice date triggers "aid paid pending." That means your current MSP coverage continues at the existing level while the appeal is processed.
Miss the 10-day window (but still within 30 days) and you can still file a hearing — but your coverage stops on the effective date in the notice. You'll only get it restored if you win the appeal.
This is why checking the mail matters. A renewal notice that sits unopened for two weeks can cost months of premium coverage.
How to File
Form 13MP001E (H-1) (Request for a Fair Hearing) is the official filing document. You can get it at any county OKDHS office or request a copy from OKDHS. File within the deadline shown above.
Submit to:
- Mail: OKDHS Appeals Unit, P.O. Box 25352, Oklahoma City, OK 73125
- In person: Any county OKDHS Human Services Center
- Fax: OKDHS Appeals Division fax line
Keep proof of submission. If you mail it, use certified mail with return receipt. If you hand-deliver it, get a date-stamped copy.

What to Bring to the Hearing
The hearing is your chance to present evidence that OKDHS made a mistake. Gather:
The Notice of Decision — the letter that denied or terminated your benefits, including the specific reason and the income/asset calculations OKDHS used.
Your own income calculation — run the numbers yourself using BENDEX cent-drop rules and the $20 disregard. If your gross Social Security is $1,369.80, show that the countable income is $1,349 after cent-drop ($1,369) and disregard ($1,349).
Bank statements and asset documentation — if the denial was asset-based, bring proof that specific assets are exempt (irrevocable burial contracts, tribal trust assets, the homestead).
Documentation of timely response — if the case was closed for "failure to provide verification," bring proof that you submitted documents on time (email confirmations, OKDHSLive upload timestamps, date-stamped copies from a county office).
After the Hearing
The hearing officer reviews the evidence and issues a Final Order. If the order reverses the denial, the effective date follows the applicable tier rules and the hearing decision. QMB coverage is prospective, beginning the first day of the month after the eligibility determination. SLMB and QI-1 can be retroactive up to three months if you met the eligibility criteria during those months.
If you disagree with the Final Order, contact Legal Aid Services of Oklahoma promptly about further review options.
