No Worse Off Principle in Aged Care — Grandfathered Protections Explained
When Australia transitioned from Home Care Packages to Support at Home on 1 November 2025, a core promise protected existing recipients: no one already in the system would pay more or receive less. This is the "no worse off" principle (NWOP) — and understanding whether your parent qualifies can save thousands per year.
Who Qualifies for Grandfathered Status
The critical date is 12 September 2024 — the day the Aged Care Act 2024 received Royal Assent. To qualify for grandfathered protections, a person must have:
- Held an active Home Care Package on or before 12 September 2024, OR
- Been assessed and approved for a package on or before that date (even if not yet allocated), OR
- Been receiving Commonwealth Home Support Programme services and had a pending assessment
Anyone who entered the aged care system after 12 September 2024 is subject to standard Support at Home contribution rates.
What's Protected
Grandfathered recipients retain several financial advantages over new entrants:
Lower Co-Contribution Rates

For a full pensioner, the difference is stark. Under standard rates, cleaning at $95/hour costs $16.63/hour out of pocket (17.5%). Under grandfathered rates, it costs nothing.
Lower Lifetime Cap
Grandfathered recipients have a lifetime contribution cap of approximately $86,185, compared to ~$137,917 for new entrants. Once the grandfathered cap is reached, all non-clinical co-contributions stop. Given that grandfathered rates are already lower, most recipients will never approach this cap.
Unspent Funds Protection
Any HCP savings accumulated before 1 November 2025 are held in a separate budget with no quarterly rollover cap. These grandfathered unspent funds can be drawn down at any time and are not subject to the $1,000/10% rollover limit that applies to new quarterly allocations.
What's NOT Protected
The "no worse off" principle covers financial contributions and existing funding levels. It does not:
- Prevent a classification change if needs are reassessed as lower
- Exempt recipients from the new quarterly budget cycle structure
- Allow the old basic daily fee to continue (it's abolished for everyone)
- Protect against provider pricing changes — the government caps co-contributions, not provider hourly rates

What Happens If a Grandfathered Person Changes Providers
Grandfathered protections follow the person, not the provider. If a parent with NWOP status switches to a new Support at Home provider, their contribution rates, lifetime cap, and unspent funds protections carry over in full. There are no exit or entry fees under the new system.
How to Check Grandfathering Status
The parent's Notice of Decision or their monthly provider statement should indicate whether NWOP applies. If uncertain, contact My Aged Care (1800 200 422) with the parent's reference number or ask the current provider for confirmation.
If a parent was in the system before 12 September 2024 but their records don't reflect grandfathered status, request a formal review through Services Australia.
