Maine QMB Billing Protections

What QMB Actually Covers in Maine

QMB is the most comprehensive Medicare Savings Program category. In Maine, it covers:

  • Part B premium: $202.90/month in 2026 — paid in full by MaineCare
  • Part A premium: Up to $565/month in 2026 if you lack enough qualifying work credits — also paid in full
  • Part B deductible: $283/year — covered
  • Part A inpatient deductible: $1,736 per benefit period — covered
  • All Medicare coinsurance and copayments: Hospital coinsurance ($434/day for days 61–90), skilled nursing facility coinsurance, and the 20% outpatient coinsurance on Part B services

For a QMB enrollee, the out-of-pocket cost for any Medicare-covered service should be zero.

The Federal Billing Protection

Under 42 U.S.C. § 1396a(n)(3)(B), healthcare providers — including hospitals, physicians, labs, and Medicare Advantage networks — are prohibited from balance-billing QMB enrollees for Medicare Part A or Part B deductibles, coinsurance, or copayments. This is federal law, not a Maine policy, and it applies regardless of whether MaineCare actually pays the provider anything for the cost-sharing.

Here's the mechanism: MaineCare pays providers for QMB cost-sharing using a "lesser-of" policy. If the MaineCare fee schedule rate for a service is less than what Medicare already paid, MaineCare's additional payment to the provider is $0. This happens frequently, because MaineCare rates are often lower than Medicare rates.

When providers see a $0 MaineCare payment, some billing departments assume they can bill the patient for the difference. They cannot. Federal law requires providers to accept the Medicare payment plus any MaineCare payment as payment in full.

What to Do If You Get a Bill

If a provider sends a bill for Medicare cost-sharing to a QMB enrollee in Maine, here's the escalation path:

Step 1 — Notify the provider. Send a written notice to the billing department with a copy of the MaineCare QMB card and the Medicare Summary Notice. Cite 42 U.S.C. § 1396a(n)(3)(B) — the federal prohibition on QMB balance billing.

Step 2 — File a federal complaint. Call 1-800-MEDICARE (1-800-633-4227) to lodge a formal improper billing complaint. CMS issues a warning letter to the provider.

Step 3 — File a state complaint. Contact MaineCare Member Services at 1-800-977-6740 to report the billing violation. MaineCare investigates provider contract compliance.

Step 4 — Get legal help if it escalates. If the provider sends the bill to collections or threatens credit reporting, contact Legal Services for Maine Elders at 1-800-750-5353. They can issue a cease-and-desist on your behalf.

Most billing violations are automated system errors, not deliberate fraud. A written notice with the QMB card copy resolves the majority of cases at Step 1.

QMB Does Not Cover Everything

Billing protections apply only to Medicare-covered services from Medicare-participating providers. Services excluded from Medicare coverage entirely — cosmetic procedures, routine dental, most vision and hearing — remain the patient's responsibility. And providers who don't participate in Medicare aren't bound by these rules.
