Indiana Medicare Savings Program Renewal and Appeal Process

How Renewals Work

Indiana MSP coverage requires annual redetermination every 12 months. DFR uses a two-step process:

Step 1 — Ex Parte Renewal (automated). Before sending you any paperwork, DFR runs your information against SSA, Department of Workforce Development, and financial institution databases. If your income and resources are still within limits, coverage renews automatically and you receive a written Notice of Ex Parte Approval. No action needed.

Step 2 — Manual Renewal (if ex parte fails). If the automated check can't confirm eligibility, DFR mails State Form 52838 (Medicaid Redetermination Form). You have 30 calendar days to return the signed form with current income and asset verification. Miss that window and coverage closes.

QI works differently — it requires annual re-application rather than automatic renewal, because of its block-grant funding structure.

The 33-Day Appeal Deadline

If DFR denies your renewal or terminates your MSP coverage, the Notice of Action includes appeal rights. You have exactly 33 calendar days from the date on the notice to file an appeal with the Office of Administrative Law Proceedings (OALP). The 33-day window accounts for 30 statutory days plus 3 days for mailing.

After 33 days, the appeal is jurisdictionally barred — OALP cannot hear it regardless of the circumstances.

There's a critical sub-deadline within that window: if you file within 13 calendar days of the notice date, you can request continuation of benefits. That means DFR keeps your Part B buy-in active while the appeal is pending. For a termination or reduction, you can also request continued benefits if you file before the effective date of the adverse action.

The 90-Day Reinstatement Window

If your coverage closes because you didn't return verification documents on time, Indiana offers a reinstatement path. Submit the required documents within 90 days of the closure date and DFR reopens your case without requiring a brand-new application. Coverage reinstates retroactively back to the closure date.

This is different from the appeal process. An appeal challenges DFR's determination that you're ineligible. The 90-day reinstatement addresses cases where you were eligible but missed a paperwork deadline.

Reporting Changes Between Renewals

You're required to report changes in income, assets, marital status, or address within 10 calendar days. Address changes can be updated online at fssabenefits.in.gov or by calling 1-800-403-0864.

Moving out of Indiana ends your eligibility for state MSP coverage. Benefits don't automatically transfer across state lines — you need to apply through the new state's Medicaid agency.

The January COLA Risk

Social Security cost-of-living adjustments take effect in January, but Indiana doesn't update its Federal Poverty Level thresholds until March 1. A COLA increase could temporarily push your income over the old limits. DFR handles this with the COLA Disregard — the increase amount is excluded from countable income from January 1 through February 28, preventing coverage loss during the gap.

What to Do Right Now

If you receive a Notice of Action with adverse news — a denial, termination, or reduction — look at the date on the notice immediately. Count 13 days from that date. If you want to keep your benefits running during the appeal, that's your real deadline.

The Indiana Medicare Savings Programs Guide includes an appeal deadline calendar and walks through the hearing process step by step, including what evidence to bring and what OALP expects.
