Indiana Medicaid Reinstatement After Closure: The 90-Day Window

The Letter Says "Discontinued" — But You Haven't Lost Everything Yet

A Notice of Action from DFR saying your parent's Medicare Savings Program coverage has been closed feels like a final verdict. It usually isn't. Indiana has a 90-day reopening window after a closure for failure to return renewal paperwork, and using it avoids the entire headache of filing a brand-new application.

Why Closures Happen

The most common reason DFR closes an MSP case isn't that someone became ineligible. It's that verification documents weren't returned in time.

When DFR requests missing verification, the notice gives 13 calendar days to respond. If an ex parte renewal cannot be completed, DFR may mail the annual renewal packet (State Form 52838), which has a 30-calendar-day response deadline. The 90-day reopening window described here applies when existing coverage closes for failure to return renewal paperwork, not to every missed verification request.

This happens for predictable reasons. The notice went to an old address. It got lost in a stack of mail. The adult child managing the paperwork didn't visit for two weeks. The documents were mailed back but arrived a day late.

The 90-Day Reinstatement Rule

From the effective date of closure, your parent has 90 calendar days to submit the required verification documents to DFR. If the documents arrive within that window and your parent still meets the income and resource limits, DFR reopens the case retroactively. Coverage is restored without a gap, and no new application is required.

This is significantly different from a fresh application, which resets the 45-day processing clock and requires completing the full eligibility screening again.

The 90-day clock starts from the closure effective date printed on the Notice of Action — not from the date the notice was mailed or received. Check that date carefully.

How to Use the 90-Day Window

Gather the documents DFR requested. The Notice of Action or the original verification request letter lists exactly what's needed. Common items: recent bank statements (all pages), the latest Social Security benefit statement, pension or annuity statements, and proof of Indiana residency.

Submit everything at once. Upload through the FSSA Benefits Portal at fssabenefits.in.gov, fax to the local DFR county office, or hand-deliver. If uploading online, save the submission confirmation receipt — it's your proof of timely filing.

Call to confirm receipt. Contact DFR at 1-800-403-0864 after submitting. Ask the representative to confirm the documents are attached to your parent's case and that the 90-day reinstatement request has been flagged. Get the representative's name and the date of the call.

What If the 90 Days Have Passed?

The 90-day reopening window has passed. Your parent will need to file a new MSP application through the FSSA Benefits Portal or a local DFR office. The standard 45-day processing timeline applies, and there will be a gap in coverage between the closure date and the new approval.

Separately, the 33-day appeal deadline on the original Notice of Action is almost certainly expired by this point. The appeal route and the 90-day reinstatement route are different mechanisms — the appeal challenges DFR's decision, while the 90-day window is specifically for cases closed due to missing documents.

Preventing Future Closures

Set a calendar reminder 11 months after your parent's last approval or renewal. Annual redetermination notices arrive around the 12-month mark, and DFR's automated ex parte review may or may not pass without additional documents. Having bank statements and income verification ready before the notice arrives eliminates the scramble.

If your parent moves, update the address on the FSSA Benefits Portal immediately. A redetermination packet sent to an old address starts the clock whether your parent receives it or not.

Our Indiana Medicare Savings Programs guide includes a renewal calendar that maps every deadline across the 12-month cycle, plus the exact documents DFR requires at each stage — so nothing gets missed the next time around.
