You are already bathing your mother, cooking her meals, and managing her medications. IHSS can pay you for authorized caregiving services you provide — including as a spouse or a parent of an adult child with a disability. The enrollment process is straightforward, but the overtime rules and tax implications catch most families off guard.

Who Can Be an IHSS Provider

A person who is at least 18 and meets the enrollment requirements can generally become an IHSS care provider, including the recipient's spouse, adult child, parent, sibling, or any other relative. California eliminated the restriction on spouses serving as providers years ago, so a husband can be paid to care for his wife and vice versa. The recipient cannot serve as their own provider, and minors cannot enroll as providers.

To enroll, the family member completes the SOC 426 Provider Enrollment Form, passes a criminal background check through the California Department of Justice, and signs a provider agreement with the county. The background check screens for disqualifying convictions. County processing times vary, so confirm the current timing with the county.

Pay Rates and Overtime Caps

IHSS provider wages are set locally through negotiations between county Public Authorities and provider unions. As of 2026, rates range from the statewide minimum of $16.90 per hour in lower-cost counties to over $20 per hour in counties like San Francisco and Los Angeles that have negotiated higher rates.

The overtime rules are where families run into trouble. If a provider works for only one IHSS recipient, their combined weekly hours — including both standard IHSS and any Waiver Personal Care Services hours — cannot exceed 70 hours and 45 minutes per workweek. If a provider works for multiple recipients, the cap drops to 66 hours per week. Any hours worked beyond these limits are not compensated.

These caps mean that a family member providing round-the-clock care to a parent with severe dementia will hit the weekly ceiling long before covering all needed hours. Families in this situation often enroll a second provider — another relative or a hired aide — to cover the remaining shifts.

Tax Implications

For a provider who lives in the same home as the recipient and meets the applicable requirements, qualifying Medicaid waiver payments for care provided in that shared home may be excluded from federal gross income under IRS Notice 2014-7. The exclusion is not automatic merely because the provider works in the recipient's home; if the provider maintains another home, the payments may not qualify.

FICA is not determined simply by the family relationship. The IRS says it depends on whether the provider is an employee of the agency, an employee of the care recipient, or an independent contractor, plus any applicable domestic-service exception. Confirm the worker status and withholding with the payer or a tax professional before estimating payroll taxes.

Providers receive a W-2 from the State Controller's Office. For nontaxable Medicaid waiver payments, the IRS says amounts may appear in Box 12 with Code II; reporting depends on what appears in Box 1 and the current Form 1040 instructions. Do not alter the W-2 or simply write "Notice 2014-7" on it.

Getting Started After Hospital Discharge

The fastest path to enrollment is applying for IHSS while your parent is still in the hospital or immediately after discharge. Provide the county with your parent's discharge records and documentation of their functional limitations; assessment and enrollment timing varies by county.

Ask the hospital social worker to note IHSS as part of the discharge plan and to provide documentation of your parent's functional limitations. Then file the SOC 295 application with your county's IHSS office and simultaneously submit your provider enrollment paperwork.
