Your parent needs to move into residential aged care. The facility is handing you a resident agreement and asking who has legal authority to sign. If your parent can't sign for themselves, can you just sign on their behalf? The answer depends entirely on what documents are in place — and getting it wrong can leave you personally liable for fees you never agreed to pay.

When Guardianship Is Not Required

If your parent still has decision-making capacity, they sign the resident agreement themselves. No guardianship, no EPOA — they're an adult making their own accommodation choice. Even early-stage dementia doesn't automatically remove this right. Capacity is decision-specific: a parent might lack the capacity to manage complex investments but still understand and consent to moving into a care facility.

If your parent has lost capacity but has a valid enduring power of attorney that covers financial decisions, the appointed attorney can sign the financial components of the resident agreement — the accommodation payment (RAD/DAP), the means-tested care fee, and the daily basic fee. If your parent also executed an enduring guardianship (or its state equivalent), the appointed guardian can consent to the accommodation decision itself.

A financial EPOA alone does not necessarily cover the personal accommodation decision. Whether it is sufficient for the provider's full agreement depends on the state, the document and the facility; some providers insist on a guardian's consent for the accommodation placement separately from the financial arrangements.

When Guardianship Is Required

Guardianship becomes necessary when your parent has lost capacity and no enduring documents exist. Without an EPOA or enduring guardianship, no family member has automatic legal authority to sign an aged care contract on their behalf.

In this situation, you need to apply to your state's civil and administrative tribunal — NCAT in NSW, VCAT in Victoria, QCAT in Queensland — for a guardianship and/or financial administration order. These applications are free to file across all states.

The practical problem is timing. The tribunal process may not match the placement deadline, particularly after a hospital discharge when the discharge planner is pressing for a placement.

The Personal Liability Trap

Here's what catches families off guard: if you sign a resident agreement without proper legal authority, you may be signing in your personal capacity rather than as your parent's legal representative. Some aged care contracts include clauses that make the signatory personally liable for accommodation payments if the resident's estate can't cover them.

Before signing anything, confirm that the contract clearly identifies you as the attorney or guardian acting on behalf of the resident — not as a guarantor or co-signer. If the contract language is ambiguous, ask the provider to amend it before you sign.

Urgent Tribunal Applications

If your parent needs immediate aged care placement and has no enduring documents, contact the tribunal about its urgent or interim pathway. In NSW, NCAT and in Victoria, VCAT have urgent processes for guardianship matters; ask which application and evidence are required.

You'll need a medical or psychological assessment report — usually less than three months old — documenting your parent's cognitive impairment and its impact on their decision-making. Contact the tribunal's guardianship division directly to explain the urgency.

Setting Up Authority Before the Crisis

The resident agreement problem disappears entirely if your parent executes enduring documents while they still have capacity. A financial EPOA gives your nominated attorney the power to negotiate and sign the accommodation payment arrangements. An enduring guardianship gives the appointed guardian the authority to consent to the placement decision.
