When Emergency Guardianship Applies

Emergency guardianship under ET Section 13-709 exists for one scenario: an adult is living in conditions that present a substantial risk of death or immediate serious physical harm, and they lack the capacity to consent to protective services. This is not a shortcut around the standard guardianship process — it is a crisis intervention with strict limits.

Common triggers include a parent found in a home with no working utilities in extreme weather, a parent with untreated medical emergencies who refuses hospital transport, or a parent whose self-neglect leaves them at immediate risk of serious physical harm.

The 144-Hour Clock

An emergency guardianship order in Maryland is valid for exactly 144 hours — six days. The court can issue the order after a hearing held within 24 hours of the petition filing. The standard for granting the order is the same as regular guardianship: clear and convincing evidence of incapacity and danger.

The temporary guardian's authority is strictly limited to the specific services needed to resolve the immediate emergency. The court will not grant broad financial or personal authority through an emergency order. If the parent needs hospitalization or an involuntary change of residence, the judge must make a specific clinical necessity finding in the written order.

Converting to Permanent Guardianship

The 144-hour limit means the emergency order expires in less than a week. If the crisis that triggered the petition reflects an ongoing incapacity — not a temporary medical episode — the temporary guardian must file two things before the 144 hours run out:

1. An extension petition to keep the emergency order in effect
2. A standard petition for guardianship under ET Section 13-705

Once both petitions are filed, the emergency order extends and the court schedules a permanent guardianship hearing on an expedited basis within 60 days. During this window, the temporary guardian continues to manage the specific crisis while the full guardianship process — clinical certificates, service of process, hearing — plays out.

Missing the 144-hour filing deadline means the emergency order expires and the parent returns to their prior legal status, regardless of whether the underlying danger has been resolved.

What You Need to File

The emergency petition requires evidence from medical professionals showing the parent lacks capacity to make decisions about their safety. The difference is speed — the court hearing happens within hours instead of weeks.

You still need to demonstrate that no less restrictive alternative is available. If the parent has a durable power of attorney or advance directive that an agent can activate, the court will expect you to explain why those existing instruments are insufficient to address the emergency.

The Cost of Delay

Families sometimes avoid emergency guardianship because the process sounds extreme. The alternative is worse. Without legal authority, you cannot force medical treatment, move your parent to safety, or protect them from unsafe conditions. Emergency departments may stabilize and discharge a patient back into the same dangerous conditions if no one has legal standing to intervene.

The standard guardianship process in Maryland takes months. When your parent faces immediate danger, those months are not available. Emergency guardianship bridges the gap while the permanent process moves forward.
