When an Emergency Petition Is Warranted
Standard guardianship proceedings in DC include an initial hearing approximately one month after filing and further court steps. That timeline is unworkable when a parent is in immediate danger — a stroke victim about to be discharged from the hospital with no one authorized to accept them into a rehab facility, a parent with advanced dementia wandering out of their apartment, or a situation where someone is actively exploiting a vulnerable adult's finances.
DC Superior Court's Probate Division recognizes three categories of expedited temporary appointments under D.C. Code § 21-2044(d) and § 21-2055(b)(1):
- Emergency Guardian: Appointed for a strict, non-extendable period of 21 days to address immediate health, safety, or medical treatment crises
- Health Care Guardian: Appointed for up to 90 days to manage ongoing critical medical placements or treatment decisions
- Provisional Guardian: Appointed for up to 6 months to oversee care transitions or manage structured support services
The 21-day emergency guardian is the fastest path. The court can grant the appointment on an expedited basis when the petition demonstrates that waiting for a standard proceeding would expose the parent to serious physical harm or medical neglect.
Filing the Emergency Petition
The filing goes to the same Probate Division at 515 5th Street NW, Third Floor, Washington, DC 20001. For true emergencies outside of normal business hours, the court accepts electronic filings at [email protected]. The Probate Division's emergency helpline is 202-879-9436.
The emergency petition must establish:
- Imminent risk: Specific facts showing that the parent faces immediate danger to their health, safety, or property that cannot wait for a standard proceeding
- No less restrictive alternative: Evidence that a power of attorney, statutory surrogate, or voluntary arrangement cannot resolve the crisis (typically because the parent lacks capacity to consent)
- The proposed guardian's qualifications: Your relationship to the parent, your ability to provide immediate care or make immediate decisions, and any relevant background
The court is evaluating the urgent need for temporary relief rather than deciding the entire long-term case. But you still need documentation. Hospital records, physician statements, police reports, Adult Protective Services referrals, or sworn declarations from witnesses who observed the dangerous situation all strengthen the petition.
What the Emergency Guardian Can and Cannot Do
An emergency guardian's authority is narrow and time-limited. During the 21-day period, you can:
- Consent to emergency medical treatment
- Authorize admission to a healthcare facility
- Make immediate decisions about the parent's physical safety and housing
- Prevent imminent financial exploitation (if the emergency order includes protective provisions)
You cannot use a 21-day emergency guardianship to sell property, restructure finances, or make long-term care placement decisions. Those require either a full guardianship/conservatorship or the longer-duration healthcare or provisional guardian appointment.

Converting to a Permanent Guardianship
The 21-day emergency appointment is a bridge, not a destination. Before the 21 days expire, you need to file a standard Petition for a General Proceeding if you want ongoing authority. The emergency appointment cannot be extended — once the 21 days run out, the authority vanishes, and you are back to having no legal standing unless a standard proceeding is underway.
The 90-day health care guardian appointment gives you more breathing room to prepare a permanent petition. If the crisis is medical in nature — your parent needs ongoing treatment authorization, facility transfers, or rehabilitation placement — the healthcare guardian path provides enough time to file the standard petition and allow the court's process (appointing counsel, scheduling the examiner, serving notice) to play out.
Hospital Discharge Scenarios
The most common trigger for emergency guardianship petitions in DC is hospital discharge planning. When a parent is hospitalized following a stroke, fall, or acute cognitive event, the hospital's discharge planning team starts pressuring the family within days to accept a transfer to a rehabilitation facility or skilled nursing home. If no one has legal authority to sign admission paperwork — because the parent cannot consent and no POA exists — the family is stuck.
In this situation, include the imminent discharge facts and the specific care decision requiring temporary authority in the emergency petition, and contact the Probate Division about the appropriate emergency filing.
