Utah Medicare Savings Program Denial: How to Appeal Through DWS

The denial letter from DWS says your parent doesn't qualify. Before you accept that, check where they filed the appeal — because Utah splits its hearing system between two agencies, and filing with the wrong one wastes weeks.

Two Agencies, Two Appeal Systems

Utah divides administrative hearings between separate bodies:

DWS Division of Adjudications handles disputes about financial and non-financial eligibility — income calculations, asset overages, household composition, missed renewal closures, and verification failures. This is where MSP denials go.

File online at jobs.utah.gov/appeals or by mail to DWS Adjudications.

DHHS Office of Administrative Hearings (OAH) handles medical necessity disputes, clinical service denials, waiver assessments, and ACO managed care disputes.

File by emailing [email protected] or mailing OAH at P.O. Box 143105, Salt Lake City, UT 84114-3105.

Filing an MSP eligibility appeal with DHHS OAH instead of DWS results in a jurisdictional rejection and administrative delays.

Filing Deadlines

You have 90 calendar days from the date on the denial notice to request a fair hearing. But if your parent is currently enrolled in an MSP and receives a termination or reduction notice, the timeline for preserving benefits is much shorter.

To keep benefits running during the appeal (called "Aid Paid Pending"), file the hearing request and explicitly request continued benefits within 10 calendar days of the notice date — or before the effective date of the adverse action, whichever comes first. If the hearing officer ultimately upholds the denial, the state can recover benefits paid during the appeal period.

What the Denial Notice Tells You

DWS denial notices must include:

  • The specific legal citation under Utah Administrative Code R414
  • The factual reason (income over limits, excess assets, missing documentation)
  • Instructions for requesting a fair hearing

Read the reason carefully. The most common MSP denials stem from:

  • Excess countable income — often because DWS counted gross Social Security before applying the $20 disregard, or counted income from a non-applicant household member
  • Excess resources — frequently from jointly held bank accounts where the co-owner's contributions weren't documented
  • Failure to provide documentation within the 10–15 day verification window
  • Missing Medicare Part A entitlement — for applicants who lack premium-free Part A and haven't completed conditional enrollment at SSA

The Documentation Denial

If DWS denied the application because your parent didn't respond to a verification request in time, submit the documents with the hearing request to contest the denial.
