Tennessee QMB Balance Billing Protection: What to Do When a Provider Bills You

Your parent has QMB through TennCare, which means Medicare deductibles, copays, and coinsurance are supposed to be covered. Then a bill arrives from their doctor's office for $347 in coinsurance. The bill is real — and it's illegal.

Federal law under 42 U.S.C. § 1396a(n)(3)(B) prohibits any Medicare-enrolled provider from billing a QMB enrollee for Medicare Part A or Part B cost-sharing. This isn't a guideline. It's a statutory prohibition that applies in every state, including Tennessee.

Why Providers Send These Bills Anyway

Tennessee processes Medicare crossover claims using a "lesser-of" reimbursement method. On professional claims, TennCare pays the lesser of the actual Medicare cost-sharing amount or the difference between the Medicare-approved amount and TennCare's Medicaid fee schedule rate.

Because TennCare's Medicaid rates are frequently lower than what Medicare pays, the state's calculation often results in a $0 payment to the provider on the crossover claim. The provider's automated billing system sees $0 from Medicaid and generates a patient bill for the remaining balance.

That $0 payment does not mean your parent owes the money. The provider is legally required to absorb the remaining cost-sharing as a write-off. They cannot transfer it to the patient.

Who Gets This Protection

Balance-billing protection applies to QMB enrollees only. SLMB and QI enrollees do not have it — those programs pay the Part B premium but do not cover cost-sharing, and providers can bill SLMB and QI patients for deductibles, copays, and coinsurance.

The protection applies:

  • Whether the provider is in-network or out-of-network
  • Whether your parent has Original Medicare or a Medicare Advantage plan
  • Regardless of what TennCare pays (or doesn't pay) on the crossover claim

How to Stop an Illegal Bill

If your parent receives a balance bill or collection notice for Medicare cost-sharing:

Step 1: Check the Medicare Summary Notice. Original Medicare's MSN explicitly states: "If you are enrolled in the QMB program, you have no legal obligation to pay this bill." Look for this language on the explanation for the service in question.

Step 2: Send a written notice to the provider's billing department. Include a copy of your parent's TennCare QMB approval notice and Medicare card, and cite 42 U.S.C. § 1396a(n)(3)(B). Request that the balance be written off.

Step 3: Call 1-800-MEDICARE (1-800-633-4227). CMS logs formal QMB balance-billing complaints, sends warning letters to non-compliant providers, and can impose administrative sanctions if the provider continues billing.

Step 4: File a complaint with TennCare. Contact TennCare's Family Services team or your parent's Managed Care Organization compliance department. If your parent is in a Medicare Advantage plan, the plan's compliance office should also be notified.

Most improper bills are resolved at Step 2 — once the provider's billing department sees the QMB approval notice and the federal statute citation, they write it off. The ones that escalate to 1-800-MEDICARE typically involve providers who genuinely don't understand the law, not ones deliberately trying to collect.

Don't Pay It

If your parent has already paid, contact the provider's billing department and 1-800-MEDICARE to ask about disputing the payment. If the bill goes to collections, the QMB billing protection still applies to Medicare cost-sharing; report the collection notice to 1-800-MEDICARE.
