South Dakota Medicaid Transfer Penalty

The Penalty Formula

When the South Dakota Department of Social Services finds an uncompensated transfer during the 60-month lookback, it imposes a penalty period — a stretch of time during which Medicaid will not pay for nursing facility or HOPE waiver services. The length of the penalty is calculated by dividing the total value of all uncompensated transfers by a daily divisor.

In 2026, South Dakota's daily penalty divisor is $320.55, which reflects the state's average daily cost of nursing home care ($9,749.92 per month).

The formula:

Penalty days = Total uncompensated transfer value ÷ $320.55

Worked Examples

Example 1 — Small gifts that add up: A parent gave $5,000 to each of their four grandchildren every Christmas for the last four years. Total: $80,000 in gifts. The penalty: $80,000 ÷ $320.55 ≈ 249.6 days (about 8.3 months) of Medicaid ineligibility.

Example 2 — Property below market value: A parent sold a quarter-section of ranch land worth $200,000 to a child for $50,000. The uncompensated portion is $150,000. The penalty: $150,000 ÷ $320.55 ≈ 467.9 days (about 15.6 months).

Example 3 — Paying for a child's home repair: A parent paid $25,000 to re-roof their daughter's house. Because the parent received nothing in return, the entire amount is an uncompensated transfer. The penalty: $25,000 ÷ $320.55 = 78 days (about 2.6 months).

When the Penalty Clock Starts

The penalty period does not begin when the gift was made. It starts on the date when all three conditions are met simultaneously:

  1. The applicant is residing in a nursing facility (or receiving HOPE waiver services)
  2. The applicant has been clinically approved for nursing-facility-level care
  3. The applicant's countable assets are at or below $2,000

This delayed start is the penalty's sharpest edge. A family might assume the penalty is nearly over because the gift was made three years ago, but the penalty clock hasn't started yet because the parent only just entered a facility and applied. The full penalty period runs from the date the three conditions are met, and the family pays the facility's private-pay rate — often $7,500 to $9,500 per month — for every day of the penalty.

Multiple Transfers Are Combined

DSS doesn't calculate separate penalties for each gift. All uncompensated transfers within the 60-month lookback are aggregated into a single total, and one penalty period is calculated from that combined figure. A series of small gifts that each seemed insignificant can create a penalty period of many months.

How to Avoid or Minimize Penalties

Wait out the window. If transfers were made near the start of the 60-month lookback and the parent's health allows, delaying the application until those transfers fall outside the 60-month window eliminates them from the calculation.

Return the assets. If a child received a gift and can return it in full, DSS will exclude the returned amount from the penalty calculation. Partial returns reduce the penalty proportionally.

Establish a caregiver agreement. If a child is providing ongoing care to a parent, a formal caregiver agreement — signed before the care begins, with compensation at fair market rates — converts what would otherwise look like gifts into legitimate compensation for services rendered.

Document fair-value transactions. When a parent pays for home improvements, medical expenses, or vehicle purchases, keep receipts showing that they received equivalent value. Fair-value exchanges are not uncompensated transfers.
