How to Appeal a Medicare Savings Program Denial in South Dakota
A denial letter from South Dakota DSS doesn't mean your parent is permanently locked out of the Medicare Savings Program. It means DSS made an eligibility determination — and you have 30 days to challenge it through a fair hearing.
The 30-Day Window
The appeal deadline is strict: 30 calendar days from the date printed on the DSS adverse notice. Not from the date you received it, not from the date you opened the envelope. The date on the notice.
A written request must reach the Office of Administrative Hearings within that window. Send it to:
Office of Administrative Hearings 700 Governors Drive, Pierre, SD 57501 Phone: 605-773-6851 | Fax: 605-773-6873 Email: [email protected]
If you're appealing a benefit closure or reduction rather than an initial denial, there's an even tighter deadline: filing within 10 to 15 days of the notice date can keep benefits running unchanged while the appeal is pending. File late within the 30-day window and you still get a hearing, but benefits may stop while you wait.
What Gets Appealed
Common reasons DSS denies or terminates Medicare Savings Program benefits:
- Income over the limit — DSS calculated countable income above the threshold for all three tiers
- Resources over the limit — bank accounts, CDs, or other countable assets exceeded $9,950 (individual) or $14,910 (couple)
- Missing verification — the applicant didn't submit required documents within the response window
- Failure to return renewal — annual redetermination form wasn't returned within 30 days
The denial notice should specify the reason. Understanding why DSS denied the application tells you what evidence to bring to the hearing.
How Fair Hearings Work
The hearing is an informal legal proceeding conducted by an impartial Administrative Law Judge (ALJ) from the Office of Administrative Hearings — an independent tribunal, not a DSS employee. You don't need a lawyer, though legal aid organizations can represent you.
At the hearing, you have the right to:
- Examine the complete DSS case file before the hearing
- Present witnesses and documentary evidence
- Cross-examine DSS eligibility specialists
- Make oral arguments explaining why DSS got the determination wrong
Pre-hearing exhibit deadline: Copies of all documents, financial records, and evidence must be delivered to both the ALJ and DSS at least five business days before the hearing.
The ALJ must issue a written final decision within 90 calendar days of the appeal filing date. If you disagree with the ALJ's decision, judicial review is available in South Dakota Circuit Court under SDCL Chapter 1-26.

When an Appeal Makes Sense
The most fruitful appeals involve income or resource miscalculations. If DSS counted an exempt asset (the primary home, one vehicle, an irrevocable burial contract) against the resource limit, or if DSS used net Social Security income instead of applying the $20 general disregard to gross income, the math may work in your favor.
For denials based on missing documentation, contact DSS or legal aid promptly about the notice and missing records before choosing whether to reapply or appeal. If you are considering an appeal, the 30-day deadline still runs from the date on the notice.
