South Carolina Medicare Savings Program Denied: How to Appeal Through a Fair Hearing

A denial letter from SCDHHS doesn't mean the answer is final. If your parent was denied for a Medicare Savings Program — or if coverage was terminated at renewal — South Carolina provides a formal appeals process through administrative fair hearings. The same process applies whether the issue is a denied initial application, a tier change (QMB to SLMB), or a termination for exceeding income or asset limits.

Reading the Denial Notice

Start with the reason given in the denial or termination notice — typically that income exceeded the limit for the tier applied for, that countable assets exceeded $9,950 (individual) or $14,910 (couple), or that verification documents weren't submitted in time.

Read the reason carefully. A denial based on income may have miscounted a disregard or included income that should have been excluded (VA Aid and Attendance, for example, is fully excluded). An asset denial may have counted the primary residence or a burial fund that should have been exempt.

Requesting a Fair Hearing

Your parent has the right to a fair hearing under South Carolina administrative law. The request must be filed in writing with SCDHHS no later than 30 calendar days from the date on the notice. Acting quickly matters: to request continued benefits ("aid paid pending") during an appeal of a termination or reduction, submit the hearing request within 10 calendar days of the notice date. If the hearing officer upholds the termination, SCDHHS may seek recovery of premiums paid during the appeal.

The hearing is conducted by an administrative hearing officer, not the same person who made the original eligibility decision. It can typically be done by phone, which is important for seniors with mobility limitations or caregivers managing from out of state.

Building the Case

The hearing is your parent's opportunity to present evidence that the denial was wrong. Common winning arguments:

Income miscalculation: Bring documentation showing the $20 general disregard wasn't applied, that earned income exclusions were missed, or that an income source was incorrectly categorized. Social Security award letters and pay stubs serve as evidence.

Asset miscount: Bank statements showing that a joint account's funds belong to the co-owner, burial fund documentation proving proper segregation, or proof that a retirement account is annuitized and the principal shouldn't count.

Procedural errors: Evidence that verification documents were submitted on time (fax confirmations, certified mail receipts) if the denial was based on missing documentation.

Free Legal Help

South Carolina Legal Services (SCLS) provides free legal representation to qualifying low-income residents for contested administrative matters, including MSP fair hearings. SCLS can represent your parent at the hearing and handle the paperwork. Their services are specifically available for cases involving denied benefits — they don't handle routine application filing, but appeals are squarely in their scope.

I-CARE (Insurance Counseling Assistance and Referrals for Elders) counselors through the South Carolina Department on Aging can also help explain the hearing process and review the denial reason, though they can't serve as legal representatives.

After the Hearing

If the hearing officer reverses the denial, SCDHHS must process the MSP approval and begin coverage. If the decision is upheld, your parent can reapply immediately with corrected documentation — there's no waiting period. Sometimes the right move after a denial is to reapply with better evidence rather than appeal.
