You have a durable financial power of attorney for your parent. You call Social Security to redirect their benefit payments. The representative tells you the POA is irrelevant — they don't accept it. Welcome to one of the most frustrating gaps in elder care legal authority.
Why Social Security Ignores Your POA
The Social Security Administration is a federal agency governed by federal regulations (20 C.F.R. § 404.2001). It does not recognize state-issued powers of attorney for managing benefit payments. Not Colorado's, not any state's.
If your parent can no longer manage their Social Security, SSI, or SSDI payments, you must apply separately through the SSA to become their designated Representative Payee. A state POA — no matter how comprehensive — does not give you authority over federal benefits.
What a Representative Payee Does
A Representative Payee receives your parent's Social Security payments directly and uses them exclusively for your parent's needs: housing, food, medical care, clothing, and personal expenses. The SSA requires annual accounting of how the funds were spent.
The payee designation is made by the SSA itself based on its own evaluation of your parent's incapacity. You cannot self-appoint.
To apply:
- Contact your local Social Security office or call 1-800-772-1213
- Complete Form SSA-11 (Request to Be Selected as Payee)
- Provide a clinical evaluation from your parent's physician documenting their incapacity
- The SSA investigates and may interview your parent before approving the designation
The SSA prioritizes family members as payees — spouses, then parents, then adult children. The process typically takes 30–60 days.
What a POA Still Covers
While a Representative Payee manages Social Security income, a durable financial POA under C.R.S. § 15-14-741 covers everything else:
- Bank accounts and savings
- Investment and retirement accounts
- Real property transactions
- Tax filings
- Insurance policies
- Private pension and retirement payments
- Medicaid applications and benefits coordination
- Bill payments and debt management
Most families need both: a Representative Payee for federal benefits and a financial POA for all other assets and accounts.

The SSA generally recognizes court-appointed fiduciaries, though it still conducts its own review before approving payee status.
Don't Leave a Gap in Coverage
