QMB Billing Protections in Wisconsin: What Providers Cannot Charge You

The Federal Billing Ban

Under 42 U.S.C. § 1396a(a)(25)(B) and 42 CFR § 447.15, Medicare providers — physicians, hospitals, labs, suppliers, and Medicare Advantage plans — are strictly prohibited from billing QMB enrollees for Medicare Part A and Part B deductibles, coinsurance, or copayments. Full stop.

This applies regardless of how much Wisconsin Medicaid actually pays the provider. When a provider treats a QMB patient, they submit the claim to Medicare first. Medicare pays its share, then crosses the claim over to ForwardHealth (Wisconsin's Medicaid system). Wisconsin Medicaid evaluates the remaining cost-sharing and may pay some, all, or none of it depending on the state fee schedule.

Even when ForwardHealth pays $0 — which happens whenever Medicare's payment already meets or exceeds Wisconsin's fee schedule rate — the provider cannot bill the patient for the difference. The ban on balance billing is absolute.

Why It Happens Anyway

Improper billing of QMB enrollees is common. Billing departments often don't check Medicaid status before sending statements. Some providers confuse QMB with full Medicaid and tell patients "we don't take Medicaid." QMB is not full Medicaid — it's a Medicare cost-sharing protection. The provider submits the Medicare claim first; any remaining Medicare cost-sharing is protected and cannot be passed on to the patient.

Reddit posts from QMB enrollees describe exactly this confusion: providers telling Medicare Advantage members with QMB that they "don't take Medicaid," or sending bills for amounts that ForwardHealth declined to pay.

What to Do If You Get a Bill

Step 1 — Contact the billing department. Tell them the patient has QMB status and that balance billing is prohibited under federal law. Reference 42 U.S.C. § 1396a(a)(25)(B). Ask them to check the patient's Medicaid eligibility in the ForwardHealth portal.

Step 2 — Check the Medicare Summary Notice. The MSN (the explanation of benefits from Medicare) displays a QMB protection statement: "You cannot be billed for Medicare deductibles, coinsurance, or copayments." This is proof the system recognizes QMB status.

Step 3 — Report to Medicare. If the provider refuses to withdraw the bill, call 1-800-MEDICARE (1-800-633-4227). CMS issues formal compliance warning letters to providers who violate the billing prohibition.

Step 4 — Contact the state. File a grievance with the Wisconsin DHS Division of Medicaid Services or call the Board on Aging and Long Term Care Medigap Helpline at 1-800-242-1060 for ombudsman advocacy.

Do not pay the bill. Do not set up a payment plan. Do not let it go to collections without taking these steps. The billing prohibition is federal law, and providers who violate it face CMS enforcement.

Protection Extends to Medicare Advantage

If your parent has a Medicare Advantage plan and QMB, the plan cannot collect cost-sharing from them for Medicare-covered services. This catches some plans off guard because they're used to collecting copays. The plan should have QMB status flagged in its system — if it doesn't, the state buy-in data transmitted to CMS is the authoritative record.

Collections and Credit Reports

If an improper QMB bill gets sent to a collection agency, the same rules apply — the account concerns Medicare cost-sharing that federal QMB rules prohibit billing to the patient. Contact the collection agency in writing, state that the patient has QMB status and that the charge violates federal law, and request that they return the account to the provider. File the same complaints with Medicare and the DHS.

A bill that's been referred to collections can still be resolved. The billing prohibition isn't waived by the passage of time or by the provider's failure to check QMB status before sending the account to collections.

Our Wisconsin Medicare Savings guide includes a ready-to-use billing dispute letter template that cites the relevant federal statutes and instructs the provider to verify QMB status through ForwardHealth.
