North Dakota Medicare Savings Program vs. Medicaid: Key Differences
They're Different Programs With Different Rules
Medicare Savings Programs and full Medicaid both operate through North Dakota HHS, use the same application forms, and are processed by the same Human Service Zone workers. That's where the similarity ends.
Medicare Savings Programs (QMB, SLMB, QI) pay Medicare costs only — premiums, deductibles, and copays. They don't cover long-term care, dental, personal care services, or anything outside Medicare's scope.
Full Medicaid covers a much broader range of services including nursing home care, home and community-based services, dental, vision, and personal care. It also comes with stricter financial requirements and different consequences.
Income and Asset Differences
| MSP (QMB) | Long-term care Medicaid | |
|---|---|---|
| Income limit (single) | $1,350/month | Varies; 209(b) state rules apply |
| Resource limit (single) | $9,950 | $3,000 |
| Transfer-of-asset rules | None | 60-month look-back |
| Spousal impoverishment rules | None | Yes (CSRA applies) |
The MSP resource limit of $9,950 is more than three times the $3,000 long-term care Medicaid limit. And MSP screening does not apply the transfer-of-asset penalties or look-back periods that long-term care Medicaid enforces.
Estate Recovery: The Critical Distinction
North Dakota operates a Medicaid estate recovery program under N.D.C.C. § 50-24.1-07, filing claims against the estates of deceased recipients who received medical assistance while aged 55 or older.
MSP-only benefits are exempt from estate recovery. Federal law (42 U.S.C. § 1396p(b)(1)(B)(ii)) and state policy specifically prohibit the state from recovering Part B premiums, Part A premiums, or cost-sharing paid under QMB, SLMB, or QI.
Estate recovery applies only if the individual expanded coverage to full Medicaid services — institutional long-term care or Home and Community-Based Services waivers.
This is the single most important distinction for families worried about the state "taking the house." If your parent receives only QMB, SLMB, or QI — and nothing else — their estate is not subject to recovery.

Dual Eligibility: QMB-Plus and SLMB-Plus
Some beneficiaries qualify for both full Medicaid and an MSP simultaneously. North Dakota uses the labels "QMB-Plus" and "SLMB-Plus" for these cases.
A QMB-Plus beneficiary gets everything QMB covers (Medicare premiums and cost-sharing) plus full Medicaid services (dental, personal care, nursing facility coverage if needed). The Medicaid side comes with its own rules, including potential estate recovery for long-term care services.
You don't apply separately for QMB-Plus or SLMB-Plus. The state determines both coverages through the same application process. If your parent qualifies for both, they receive both.
North Dakota Is a 209(b) State
North Dakota exercises its option under Section 209(b) of the Social Security Act to apply Medicaid eligibility criteria that differ from SSI rules. Getting SSI does not automatically enroll someone in QMB or SLMB — SSI recipients must be separately evaluated through state buy-in files.
This is unusual. In most states, SSI recipients get Medicaid automatically. In North Dakota, the MSP determination is a separate process regardless of SSI status.
Which Program Does Your Parent Need?
If the goal is stopping the Part B premium deduction and reducing Medicare out-of-pocket costs, a Medicare Savings Program is the right fit. If your parent needs long-term care, personal care, or services beyond what Medicare covers, full Medicaid may be necessary — but comes with stricter asset rules and estate recovery implications.
The North Dakota Medicare Savings Programs & Extra Help Guide focuses on the MSP pathway and clearly explains where MSP rules end and Medicaid rules begin, so families don't confuse the two programs during the application process.
