Nevada QMB Billing Protections: What to Do When a Doctor Bills You

The Federal Law Providers Are Breaking

If you have QMB and a doctor, hospital, lab, or imaging center sends you a bill for a Medicare deductible, coinsurance, or copay, that bill is illegal. Not just wrong — federally prohibited.

Under Section 1902(n)(3)(B) of the Social Security Act (42 U.S.C. § 1396a(n)(3)(B)), Medicare providers and suppliers are barred from billing QMB beneficiaries for Medicare Part A and Part B cost-sharing. This applies to Medicare-participating providers, whether or not they also participate in Nevada Medicaid.

The prohibition is absolute. A provider cannot bill you for Part B's $283 annual deductible, the 20% coinsurance on outpatient services, the $1,736 Part A hospital deductible, or any of the daily coinsurance amounts for extended hospital or skilled nursing facility stays. If Medicare covers the service, you owe nothing beyond what QMB doesn't cover (like routine dental, which Medicare itself doesn't cover).

Why Providers Bill Anyway

Nevada Medicaid uses a "lesser-of" reimbursement policy. The state pays the difference between what Medicare paid and Nevada Medicaid's maximum allowable rate. If Medicare already paid more than the Medicaid rate, Nevada pays the provider $0.

Providers see that $0 payment and assume they can bill the patient for the gap. They cannot. A $0 state payment does not override the federal prohibition. The remaining cost-sharing must be written off by the provider — it's a regulatory write-off, not a collectible balance.

Billing departments at smaller practices and collection agencies often don't know QMB rules. The bill comes from someone following a standard collections process who has no idea that federal law prevents them from collecting.

How to Stop the Bills

Step 1: Verify the charge is for Medicare cost-sharing

Check your Medicare Summary Notice (MSN) or the provider's invoice. Confirm the billed amount represents a Medicare deductible, coinsurance, or copay — not a non-covered service like routine dental or hearing aids.

Step 2: Contact the billing department in writing

Send a letter or fax to the provider's billing department stating:

  • You are an active QMB beneficiary in Nevada
  • Federal law under Section 1902(n)(3)(B) of the Social Security Act (42 U.S.C. § 1396a(n)(3)(B)) prohibits billing you for Medicare cost-sharing
  • Attach a copy of your DWSS Notice of Decision showing active QMB status
  • Request immediate withdrawal of the balance and confirmation in writing

Written communication creates a paper trail. Phone calls get forgotten; letters get filed.

Step 3: Escalate if the billing continues

If the provider doesn't respond or refuses to withdraw the bill:

  • Call 1-800-MEDICARE and file a formal QMB billing complaint. CMS tracks these complaints and can take enforcement action against providers.
  • Contact Nevada MAP at 1-800-307-4444. The Senior Medicare Patrol program helps beneficiaries resolve improper billing.
  • If the bill has gone to collections, send the collection agency a formal dispute notice citing federal QMB balance billing protections and demand they stop credit reporting immediately.

Step 4: Document everything

Keep copies of every bill, every letter you send, every response you receive, and every call log. If the situation escalates to a formal complaint or legal action, this documentation is your evidence.

What QMB Does Not Cover

QMB billing protections apply only to Medicare-covered services. If you receive a service that Medicare doesn't cover — routine dental care, most hearing aids, cosmetic procedures — QMB doesn't apply and you may owe the balance. Part D prescription copays are governed by Extra Help/LIS rules, not QMB billing protections.

The Nevada Medicare Savings Programs & Extra Help Guide includes a billing dispute log template and the exact letter script to send to providers and collection agencies — so you can stop illegal bills before they reach your credit report.
