The Problem Form DHS 1121A Solves

You show up to help your parent apply for Med-QUEST long-term care coverage, and the eligibility worker won't talk to you. Your parent has dementia. They can't handle the application themselves. But without formal authorization, the Department of Human Services cannot discuss the case, share documents, or accept instructions from anyone other than the applicant.

Form DHS 1121A — the Agreement to Act as an Authorized Representative — is the fix. Once completed and accepted, it lets a named representative submit applications, provide documentation, receive notices, and communicate with Med-QUEST eligibility workers on the applicant's behalf.

Who Can Serve as an Authorized Representative

An adult child, spouse, health-care surrogate, court-appointed representative, or other authorized individual can serve. There's no requirement that the representative be an attorney or hold a power of attorney — though having a durable financial POA in place makes the process smoother.

The DHS 1121A is signed by the authorized representative and requires supporting documentation of the authority — such as a health-care surrogate form, POA, court order, or other legal document. If your parent lacks capacity and no POA or court order exists, a health-care surrogate or another recognized authorized individual may still be able to act; the supporting documentation must establish that role.

How to Complete Form DHS 1121A

The form itself is straightforward — a two-page PDF available from Med-QUEST's website. Here's what each section requires:

Applicant/Member section — your parent's full name. The form's supporting-documentation section identifies the authority you are relying on; keep the attached authority document with the submission.

Authorized Representative section — your name, mailing address, and telephone number. The form does not replace the underlying authority document; attach it as supporting documentation.

Signature section — the authorized representative signs and dates the form, then attaches the supporting authority document.

Upon completion, return the original and the document authorizing you to the assigned eligibility worker. You may keep a copy for your records.

Authorized Representative vs. Power of Attorney

These are different legal instruments solving overlapping problems.

A durable financial power of attorney under HRS 551E gives your agent broad authority over financial matters — bank accounts, property, contracts, benefit applications. It's a private legal document between the principal and agent.

The DHS 1121A is a government-specific designation that tells Med-QUEST workers they can communicate with you. Even if you hold a valid POA, Med-QUEST may still request a completed 1121A because their internal systems track authorized representatives separately from general legal authority documents.

The practical advice: file both. The POA gives you legal standing to handle your parent's finances broadly. The 1121A removes bureaucratic friction with Med-QUEST specifically. They cost nothing to prepare and take less than an hour to complete.

Signing Nursing Home Admission Paperwork

The answer depends on your legal authority. If you hold a valid health care power of attorney or AHCD, you can authorize medical care and facility admissions. If you hold a financial POA, you can sign contracts that involve financial obligations.

Be careful about signing as a "responsible party." Some facilities slip language into admission contracts that makes the signer personally liable for the resident's bills. Under federal law (42 CFR § 483.15(a)(3)), a nursing home cannot require a third party to guarantee payment as a condition of admission, expedited admission, or continued stay. It may ask a resident representative with legal access to the resident's income or resources to sign a payment contract without personal financial liability. If you're signing, sign as "agent under power of attorney for [parent's name]" — never in your individual capacity.

The Med-QUEST authorized representative designation covers your interactions with the state's Medicaid program, but the facility admission contract is a separate legal document; DHS 1121A itself does not give you general authority to sign it.

Timeline and What to Expect

After submitting Form DHS 1121A, processing depends on the assigned eligibility worker and case; the form does not state a standard processing deadline. Once accepted, the designation remains in effect until the applicant withdraws it, the underlying authority document changes, or the representative stops acting. For an incapacitated person, the form also states that the Medicaid representative role terminates when a guardian or health-care POA becomes available or when the applicant dies.

If your parent is in a hospital awaiting discharge to a nursing facility, emphasize the urgency with the eligibility worker. Hospital discharge planners can sometimes expedite the process by coordinating directly with the Med-QUEST district office.
