MassHealth Buy-In Denied: What to Do Next

A denial letter from MassHealth is not the end of the process. It is the start of a 30-day window where you can request a Fair Hearing — and in many cases, the denial is based on a correctable error in how income was calculated or which program tier was applied.

Read the Denial Notice Carefully

The MassHealth Notice of Decision will state the specific reason for the denial. Common reasons include:

  • Income above the limit — MassHealth counted income that should have been disregarded, or applied individual limits to a married couple who should be evaluated separately (because they live apart or one spouse is institutionalized).
  • Missing verification — an RFI went unanswered, or MassHealth requested asset documentation that is not required for MSP-only applications.
  • Medicare eligibility issue — the system did not register Part A entitlement, which is required for MSP enrollment.

Understanding the specific denial reason determines whether you need to submit new documentation, correct MassHealth's income calculation, or file a formal appeal.

Requesting a Fair Hearing

Fair Hearings are adjudicated by the MassHealth Board of Hearings (BOH), an independent tribunal that reviews MassHealth eligibility decisions.

Filing deadline: 30 days from the date printed on the denial notice. If the application was approved at a lower tier than expected (SLMB instead of QMB, for example), you can also appeal the tier placement.

How to file: Submit a Fair Hearing request by any of these methods:

  • Fax: (617) 887-8797
  • Email: [email protected]
  • Mail: MassHealth Board of Hearings, 100 Hancock Street, 6th Floor, Quincy, MA 02171
  • Phone: (617) 847-1200 or 1-800-655-0338

The request does not need to be complicated. State your name, MassHealth ID (if assigned), the date on the denial notice, and that you disagree with the decision. The detailed arguments come later, at the hearing itself.

Aid Paid Pending

If MassHealth is terminating or reducing existing MSP coverage — not a first-time denial — you can keep current benefits running during the appeal by requesting the hearing before the effective date of the action (typically 10 to 15 days from the notice date). This is called "aid paid pending." If the Board of Hearings ultimately upholds MassHealth's decision, the state can recover benefits paid during the appeal period.

Preparing for the Hearing

During the hearing, you or your authorized representative can:

  • Inspect the official MassHealth case file before the hearing
  • Submit documentary evidence (income statements, Medicare cards, MassHealth correspondence)
  • Present witness testimony
  • Request free language interpreter services or disability accommodations

The strongest appeals come with clear documentation showing the correct income calculation. If MassHealth miscounted income — for example, by including a non-recurring lump sum as regular monthly income, or by failing to apply the $20 unearned income disregard — bring the SSA benefit verification letter and any pension statements showing the correct gross amounts.

Free Legal Help

Low-income seniors and people with disabilities can get free legal representation for MassHealth hearings through:

  • Greater Boston Legal Services: Covers Suffolk, Norfolk, Plymouth, and Bristol Counties
  • Community Legal Aid: Covers central and western Massachusetts
  • Massachusetts Law Reform Institute: Policy guidance and referrals statewide

SHINE counselors can explain the process and help organize documentation, but they do not provide legal representation at hearings.

When to Reapply Instead

If the denial was based on a procedural issue — a missed RFI deadline, for example — and you now have the requested documentation, filing a new application may be faster than going through the hearing process. A new application creates a fresh filing date. For missed renewals, MassHealth provides a 90-day reconsideration window during which you can submit the completed renewal form and have coverage restored retroactively without a new application.

The Massachusetts Medicare Savings Programs Guide includes an appeals checklist and evidence preparation worksheet to help you build the strongest possible case for a Fair Hearing.
