Louisiana QMB Balance Billing Protection

The Law Is Clear

Under Social Security Act § 1902(n)(3)(B) (42 U.S.C. § 1396a(n)(3)(B)) and 42 CFR § 447.15, Medicare providers are prohibited from billing Qualified Medicare Beneficiary enrollees for any Medicare cost-sharing. That means no bills for the Part B annual deductible ($283 in 2026), no coinsurance charges (the usual 20% for outpatient services), no Part A hospital deductible ($1,736 per benefit period), and no copayments.

This applies to every Medicare provider — physicians, hospitals, labs, imaging centers, home health agencies — regardless of whether the provider participates in Louisiana Medicaid. It applies in Original Medicare and Medicare Advantage plans. The service is considered paid in full once Medicare and any applicable Medicaid payment processes.

Why You're Still Getting Bills

Illegal billing of QMB enrollees is one of the most common problems families report. It happens for specific, predictable reasons:

Louisiana's "lesser-of" reimbursement. When LDH processes a claim for a dual-eligible patient, it compares the Medicare payment against the state Medicaid fee schedule. If Medicare already paid more than the Medicaid rate, Louisiana Medicaid sends the provider a "$0.00 Reimbursement Notice." Provider billing software reads this as a balance and automatically generates a patient statement — even though the law prohibits collecting it.

Verification gaps. Some providers check Medicaid eligibility at the time of service and get a negative response because of a data sync lag between LDH and CMS. The Explanation of Benefits then shows no secondary payer, and the billing department sends the cost-sharing amount to the patient.

Staff unfamiliarity. Front-desk and billing staff at smaller practices may not know the QMB balance billing rules. They see a Medicare copay line on the EOB and bill accordingly, as they would for any other patient.

How to Resolve an Illegal Bill

Follow this sequence before the bill goes to collections:

Step 1: Confirm your QMB status on the date of service. Check your LDH approval notice or call 1-888-342-6207 to verify your enrollment was active on the specific service date.

Step 2: Do not pay the bill. Retain all billing statements and Explanation of Benefits documents.

Step 3: Contact the provider's billing department. Provide written notice — a letter or secure message — stating that you were an active QMB on the service date and citing the specific law. A direct statement works: "The patient was an active Qualified Medicare Beneficiary on the date of service. Under Social Security Act § 1902(n)(3)(B) (42 U.S.C. § 1396a(n)(3)(B)) and 42 CFR § 447.15, Medicare providers are prohibited from billing QMB beneficiaries for Medicare deductibles or coinsurance. Please adjust this balance to zero and confirm in writing."

Step 4: Escalate to 1-800-MEDICARE. If the provider doesn't correct the bill, call 1-800-633-4227 and file an official QMB balance billing complaint. CMS tracks these complaints and can issue sanctions.

Step 5: File a state-level complaint. Contact Louisiana SHIIP at 1-800-259-5300 or the LDH Program Integrity Unit. Providers who persist in billing QMB enrollees face federal sanctions, mandatory refund orders, and potential exclusion from Medicare and Medicaid.

Protecting Yourself Going Forward

Keep a copy of your LDH QMB approval notice with you — especially when visiting a new provider. Alert the front desk before your appointment that you're a QMB enrollee and that cost-sharing should not be billed to you.

If you're in a Medicare Advantage plan, the same protection applies. The MA plan processes the claim, and any remaining cost-sharing that would normally be your responsibility is zeroed out by QMB status. If the plan's EOB shows a copay, contact the plan and reference your QMB enrollment.
