Iowa Medicare Savings Program Denied: How to Appeal

The Notice of Decision from Iowa HHS says denied. Maybe they counted income incorrectly, or missed a disregard, or closed the case because paperwork didn't arrive in time. Whatever the reason, a denial is not the final word — Iowa law gives applicants 90 days to appeal and a clear process to follow.

The 90-Day Window

Iowa HHS appeal rights fall under Iowa Code Chapter 17A and 441 IAC Chapter 7. From the date on the Notice of Decision, the applicant or their authorized representative has 90 calendar days to file an appeal requesting a fair hearing. This applies whether the MSP application was denied outright, approved at a lower tier than expected, or terminated.

Appeals are processed by the Iowa Department of Inspections, Appeals, and Licensing (DIAL), Appeals Division, not by Iowa HHS itself — which matters because the decision is reviewed by an independent Administrative Law Judge.

How to File

Iowa HHS accepts appeals through multiple channels:

Online — the Iowa HHS Appeals Portal at hhs.iowa.gov under the appeals section. This is the fastest method and creates an immediate electronic record.

Paper — Form 470-0487 ("Appeal and Request for Hearing"). Download, complete, and submit by mail or fax.

Mail or fax — send directly to the Appeals Section, Iowa Department of Health and Human Services, 1305 E Walnut Street, 5th Floor, Des Moines, IA 50319. Fax: 515-564-4044.

In person — deliver to any Iowa HHS county service center.

The 10-Day Rule for Keeping Benefits

This is the most time-sensitive piece. If Iowa HHS is terminating or reducing existing MSP coverage — not denying a new application, but cutting benefits that were already in place — the beneficiary can request "Aid Pending Appeal" within 10 calendar days of the notice date.

When requested within 10 calendar days of the notice date or before the adverse action takes effect, benefits continue uninterrupted while the appeal is processed. Part B premium payments keep going, QMB cost-sharing protections stay active. For the 10-day deadline, the clock starts on the date printed on the Notice of Decision, not the date the letter arrives in the mailbox.

There's a risk: if the Administrative Law Judge rules against the beneficiary, they may owe repayment for the benefits Iowa HHS paid during the appeal period. But for a senior who depends on QMB to avoid thousands in medical bills, maintaining coverage during the appeal is almost always worth the gamble.

What Happens at a Fair Hearing

Hearings are conducted by phone. An ALJ from DIAL runs the proceeding. The beneficiary (or their representative) presents their side — why the denial was wrong, what evidence supports eligibility, and what income or asset calculations Iowa HHS got wrong.

Before the hearing, the beneficiary has the right to review their full case record from Iowa HHS. This is important. Request the file early. Look at the income figures the caseworker used, the asset totals, and any disregards that may have been missed.

Common grounds for a successful appeal:

  • Iowa HHS used gross Social Security instead of net countable income (missed the $20 disregard)
  • An exempt asset was counted (burial funds, primary home equity, term life insurance)
  • The applicant's response to a verification request was received but not processed
  • Spousal deeming rules were applied incorrectly

Bring documentation: the Social Security Award Letter showing gross vs. net amounts, bank statements backing up the asset count, proof of exempt resources, and any correspondence with Iowa HHS.

Representing a Parent

An adult child can represent a parent at the hearing using Form 470-5526 ("Authorized Representative for Appeals"). Both the parent and the representative sign the form. A Durable Power of Attorney or guardianship order also works.

Free legal representation is available through Iowa Legal Aid at 1-800-532-1275 for seniors who meet their income eligibility requirements.

Informal Conference — A Trap to Avoid

Iowa HHS may offer an informal conference with local office staff before the formal hearing. Participating is fine — it can sometimes resolve the issue without going to hearing. But agreeing to a conference does not pause or extend the 90-day appeal deadline. If the conference doesn't resolve things, file the formal appeal before the deadline expires.

Paperwork Closures

If the case was closed because a renewal packet wasn't returned, Iowa HHS must reopen it when the completed renewal is submitted within 90 days of closure and restore coverage retroactively to the closure date without requiring a new application. For other denials or closures, use the 90-day appeal route above.
