Colorado allows emergency guardianship for situations exactly like this, but the legal standard is strict and the authority is temporary by design.

When Emergency Guardianship Applies

Colorado courts grant emergency guardianship only when the respondent faces immediate risk of substantial physical harm. This is a higher bar than the standard guardianship threshold of general incapacity. Inconvenience, poor decisions, and even gradual decline don't qualify.

Situations that typically meet the standard:

  • A parent with advanced dementia who is leaving the house unsupervised and is at physical risk
  • An elderly parent being actively exploited by a caregiver or family member, where assets or physical safety are in immediate jeopardy
  • A hospitalized parent who needs placement in a care facility but has no one legally authorized to sign admission agreements
  • A parent refusing critical medical treatment that could result in imminent death or serious harm

How to File

File JDF 843 — Petition for Emergency Appointment of Guardian. This petition must clearly document the specific facts showing immediate danger. Vague assertions about cognitive decline won't meet the standard — you need to describe concrete events, dates, and observable behaviors.

The filing fee is the same $229 as a standard guardianship case. Some courts will waive this in genuine emergencies if you file JDF 205 (Motion to File Without Payment) simultaneously.

Expedited hearing. Unlike the standard 14-day notice period, emergency petitions are heard on shortened notice — sometimes within 24 to 72 hours, depending on the court's schedule and the severity of the situation. The court may allow telephonic or limited notice to interested persons when time doesn't permit full service.

Evidence matters. Bring documentation of the emergency: medical records, police reports, photos, statements from neighbors or healthcare providers, Adult Protective Services reports. The judge needs concrete evidence of immediate risk, not just your assessment that your parent needs help.

What Emergency Letters Grant

If the court approves the petition, you'll receive temporary Letters of Guardianship with a strict 60-day expiration. During this period, you have authority to:

  • Make immediate medical decisions
  • Arrange safe housing or care facility placement
  • Prevent further exploitation or harm
  • Manage day-to-day personal care needs

The emergency letters do not grant financial authority over the parent's estate — that requires a separate conservatorship petition. You also cannot make long-term decisions about the parent's property, investments, or Medicaid planning under emergency authority alone.

The 60-Day Deadline

Emergency guardianship is a bridge, not a destination. Within the 60-day window, you must either:

  1. File a standard guardianship petition (JDF 841) with the full set of background checks, court visitor investigation, and notice requirements — then receive permanent appointment at the hearing, or

  2. Let the emergency authority expire if the circumstances that justified it have been resolved (for example, the parent regained capacity after a medical event)

If you don't file a standard petition before the 60 days run out, your authority terminates automatically. There's no extension. The court may grant a second emergency petition in extraordinary circumstances, but judges are reluctant to stack temporary orders without moving toward a permanent resolution.

Emergency guardianship exists for genuine crises — but many families end up here because they didn't plan ahead. The emergency process is stressful, expensive (you'll likely need an attorney for the expedited timeline), and still leads to the full standard guardianship process within 60 days.
