What Makes a Maine POA "Durable"
Under the Maine Uniform Power of Attorney Act (18-C M.R.S. § 5-904), every power of attorney is presumed durable by default. That means the agent's authority survives the principal's subsequent incapacity — the exact opposite of a standard POA, which terminates the moment the principal can no longer make decisions.
This default is critical for aging parents. The whole point of setting up a financial POA is to ensure someone can manage bank accounts, pay bills, and handle real estate if the parent develops dementia or suffers a stroke. A non-durable POA would die at exactly the moment the family needs it most.
The only way a Maine POA loses durability is if the document explicitly says it does. If your parent's existing POA contains language like "this power of attorney shall terminate upon my incapacity," it offers zero protection when cognitive decline hits.
Financial POA Form Requirements in Maine
Maine is one of the states that does not publish an official fill-in financial POA form. The Act provides only the agent's certification form at § 5-951 — everything else must be custom-drafted. This catches families off guard who expect to download a simple template from the state.
A valid Maine financial POA requires:
- Notarized signature — The principal's signature must be acknowledged before a notary public (§ 5-905). No witnesses are required for financial POA, unlike the health care directive.
- Statutory notices — The document must include the notice to the principal and the notice to the agent as prescribed by the Act. Without them, financial institutions can refuse to honor the document.
- Specific enumeration of powers — General grants of authority work for routine transactions, but sensitive actions require explicit language.
Hot Powers Under Title 18-C § 5-931
The most consequential drafting detail in a Maine financial POA is the "hot powers" provision. Under § 5-931, the agent cannot exercise the following authorities unless the POA specifically grants each one:
- Making gifts (including to the agent themselves)
- Creating, amending, or revoking a trust
- Changing rights of survivorship on accounts
- Modifying beneficiary designations on insurance or retirement accounts
- Delegating authority to another person
These aren't academic distinctions. When a parent needs MaineCare long-term care benefits, asset restructuring during the 60-month lookback period often involves gifts or trust modifications. An agent without explicit hot-powers language has to go back to the principal for a new document — and if capacity is already gone, the family faces a guardianship petition instead.

What Financial Institutions Expect
Even with a properly executed POA, banks and brokerage firms in Maine sometimes push back. Under § 5-920, a person presented with an acknowledged POA must generally accept it or request a certification, translation, or opinion of counsel within 7 business days. If one is requested, the person must accept the POA within 5 business days after receiving it. If a person refuses in violation of that section, a court may order acceptance and award reasonable attorney's fees and costs. Knowing this statute exists — and being willing to cite it — usually resolves institutional resistance.
The agent can also present a signed Agent's Certification (§ 5-951) confirming the POA hasn't been revoked and the principal hasn't died. Many institutions prefer this certification over reviewing the full document.
When a Financial POA Falls Short
A durable financial POA covers bank accounts, investments, real estate, tax filings, and benefit applications — but it doesn't cover:
- Medical decisions — Maine uses a separate Advance Health Care Directive for healthcare agency.
- Social Security management — The SSA requires its own Representative Payee appointment regardless of any state POA.
- Court proceedings — The agent's authority in litigation depends on the powers granted in the POA and the court's procedures; separate court authority may be needed for matters outside that grant.
