DIY Lasting Power of Attorney England

Solicitors charge £300 to £600 per LPA to fill in the same government forms you can access for free. For a straightforward family situation, that premium buys you very little. But "straightforward" has a specific meaning, and getting it wrong costs more than a solicitor ever would.

The OPG Online Service

The Office of the Public Guardian runs a free digital service for creating LPAs. You set up a GOV.UK One Login account, select the LPA type (Property and Financial Affairs, Health and Welfare, or both), and the system walks you through the information it needs: donor details, attorney and replacement attorney details, certificate provider details, and any preferences or instructions for Section 7.

The system catches some basic errors before you finalise — missing fields, obvious conflicts of interest with the certificate provider. It generates the printed forms for signature.

You still need to print the forms, sign them in the correct order with witnesses, and post them to the OPG with the £92 registration fee per document.

Where DIY Goes Wrong

The OPG's digital system doesn't protect you from every error. The most common DIY mistakes:

Wrong signing order. The donor signs first (with a witness), then the certificate provider, then each attorney (each with their own witness). Reverse the certificate provider and an attorney, and the entire application is rejected.

Ineligible certificate provider. The system asks you to name a certificate provider but won't flag every disqualifying factor. Care home managers, named attorneys, and close family members are all ineligible. A "family friend" who is also a business partner of an attorney is ineligible. These rejections catch families off guard because the relationship seems innocent.

Vague or contradictory Section 7 wording. Instructions and preferences in Section 7 shape how your attorneys exercise their authority. Poorly worded instructions can create conflicts ("never sell the house" paired with a Health and Welfare instruction to "always choose the best care home" when the house is the only asset). The OPG will flag contradictions that make the LPA unworkable.

Correction fluid or informal alterations. Any use of correction fluid or hand-written corrections on the printed forms will result in rejection. If you make a mistake, you must reprint the affected pages and resign.

When DIY Is the Right Call

DIY works well when:

  • Your parent has clear mental capacity (no borderline concerns)
  • The family structure is straightforward (no blended families, no estranged siblings likely to challenge)
  • The parent's assets are standard (residential property, savings accounts, pensions)
  • There are no business interests, overseas assets, or trust arrangements
  • Everyone agrees on who should be attorney

In these cases, the OPG's online system plus careful attention to the signing sequence gets you to the same endpoint a solicitor would — for £184 instead of £600 to £1,200.

When You Need Professional Help

Pay for a solicitor when:

  • Capacity is borderline and you need a professional certificate provider to protect the LPA against future challenges
  • The estate is complex — business assets, commercial property, multiple properties, overseas holdings, or family trusts
  • Family dynamics are contentious — siblings who may object, a blended family, or a parent in a second marriage
  • You need specialised Section 7 instructions — such as business management powers, investment restrictions, or detailed care preferences
