The Tax Break Most Illinois Family Caregivers Miss
If you are getting paid through the Illinois Community Care Program or the Medicaid Persons Who Are Elderly waiver to care for a parent or spouse at home, there is a good chance a significant portion of that income is tax-free. IRS Notice 2014-7 created an exclusion that most paid family caregivers in Illinois either do not know about or do not apply correctly on their returns.
IRS Notice 2014-7: The Medicaid Waiver Income Exclusion
In 2014, the IRS ruled that payments received under a Medicaid waiver program for providing in-home care to a person you live with are excludable from gross income. The reasoning: these payments function as difficulty-of-care foster care payments, which have long been tax-exempt.
Who qualifies in Illinois:
- You are a family member hired as a paid caregiver through a state-approved home care agency under the CCP or the Elderly Waiver
- You live in the same home as the person you are caring for
- Your compensation comes from a Medicaid-funded waiver or a state program that operates as a Medicaid alternative (the CCP qualifies)
What is excluded: Qualifying payments can be excluded from federal gross income. That does not by itself determine eligibility for every income-tested credit or benefit, which has separate rules.
The live-in requirement is non-negotiable. If you provide care for a parent but live in a separate household, the exclusion does not apply. You are simply a W-2 employee of the home care agency, and your wages are fully taxable.
How to Apply the Exclusion on Your Tax Return
Your W-2 may still report the full payment in Box 1. Notice 2014-7 supports the federal exclusion, but the reporting mechanics depend on how the agency reports the payments and on the current IRS instructions.
Keep the W-2 and proof that the payments qualify under Notice 2014-7. Before filing, confirm the current reporting method with a tax preparer or tax software that specifically supports Medicaid waiver payments; do not assume a particular Form 1040 line or adjustment without that guidance.

Standard hourly rates for CCP homemakers in Illinois range from $13 to $25 per hour, with Chicago metro area averages around $19 per hour.
If you are a live-in caregiver who qualifies for the Notice 2014-7 exclusion, ask the agency how it reports and withholds on those payments. Federal income-tax treatment and payroll-tax treatment are separate questions; confirm both with a tax preparer before changing a W-4.
What to Do Before Filing
Gather your W-2, proof that you live with the care recipient (lease, utility bills, or a statement from the home care agency), and documentation showing the payments come from a Medicaid waiver or CCP-funded program. If your tax situation is straightforward, you can apply the exclusion yourself.
