California Medicare Savings Program for Immigrants and Non-Citizens

The Federal Requirement

The federal Medicare Savings Programs — QMB, SLMB, QI, and QDWI — require U.S. citizenship or satisfactory immigration status under federal Medicaid rules. Lawful Permanent Resident status is one example; the county reviews an applicant's documents to determine whether their status qualifies.

California funds full-scope Medi-Cal for income-eligible residents regardless of immigration status through state dollars. But the MSPs specifically — because they are federally funded Medicaid programs paying Medicare premiums — require documented qualified status at the federal level.

This distinction matters. Your parent may have full-scope Medi-Cal under a state-only aid code and still not qualify for QMB or SLMB if their immigration status does not meet the federal threshold. In that case, the state pays their Medi-Cal benefits but cannot use federal funds to pay their Medicare premiums through the MSP pathway.

Who Qualifies

Whether a non-citizen qualifies depends on whether their documented immigration status meets the federal satisfactory-status requirement. California's state-funded full-scope Medi-Cal is separate from federal MSP eligibility; state-funded Medi-Cal coverage alone does not establish eligibility for an MSP.

The Part A Buy-In for Immigrants

Senate Bill 311, effective January 1, 2025, made California a Medicare Part A buy-in state. This is especially relevant for qualified immigrants who lack the 40 work quarters needed for premium-free Part A. Before SB 311, they had to visit an SSA office during the General Enrollment Period (January through March) to file a conditional Part A application before the county could process a QMB application.

Under the current rules, a qualified immigrant who meets QMB income and asset criteria applies directly to their county welfare department at any time of year. If approved for QMB, the state automatically enrolls them in Part A through the buy-in file and pays the full Part A premium (up to $565 per month in 2026) to CMS. No conditional filing at SSA is needed.

This removes a significant administrative barrier that previously left many immigrant seniors cycling through the GEP window, missing deadlines, and going months without Part A coverage.

H.R. 1 Changes Effective October 2026

Section 71109 of federal H.R. 1 narrowed federal Medicaid eligibility for certain Qualified Non-Citizens effective October 1, 2026.

California issued ACWDL 26-13 outlining its transition plan. The state is using General Fund dollars to maintain MSP buy-in coverage for affected residents through early 2027, giving the county welfare departments time to re-verify eligibility and transition impacted beneficiaries. This is a state-level protection that other states may not offer.

Watch for county notices and respond to any Request for Information (Form MC 355) within 30 calendar days. Before proposing a denial for failure to provide information, the county must make a second contact by phone or written reminder.

What to Do Now

If your parent is an immigrant who might qualify, start by confirming their immigration status category against the federal qualified status list. Bring their green card, immigration documents, and naturalization papers to the county welfare department along with the standard MSP application documents — Social Security benefit letter, bank statements, and Medicare card.

If you are applying on their behalf, file Form MC 382 (Authorized Representative) so the county can communicate with you directly. This is especially important for families where the parent speaks limited English and the adult child is navigating the county system on their behalf.
