Who Handles Medicare Discharge Appeals in North Dakota

The federal government contracts with Beneficiary and Family Centered Care Quality Improvement Organizations (BFCC-QIOs) to review discharge decisions independently. In North Dakota, the designated BFCC-QIO is Acentra Health, serving CMS Region 8.

The Fast-Track Appeal Timeline

Before the planned discharge date: Call Acentra Health at 1-888-317-0891. You can also initiate the appeal through Acentra's online portal. The appeal must be filed before your parent physically leaves the hospital.

Within hours of your call: Acentra notifies the hospital that an appeal has been filed. The hospital must immediately halt the discharge process.

By noon the next day: The hospital must deliver a "Detailed Notice of Discharge" (Form CMS-10066) to your parent. This document must state the specific clinical reasons justifying the discharge — not just a generic "patient is stable."

Within 24-48 hours of receiving records: A board-certified physician at Acentra Health reviews the complete medical chart and issues a binding decision.

What Happens After Acentra's Decision

If Acentra rules in your parent's favor: Hospital coverage continues under Medicare. The hospital must develop a new, safer discharge plan before attempting another discharge.

If Acentra rules in the hospital's favor: Your parent becomes financially responsible for hospital charges beginning at noon of the day following Acentra's formal notification. This gives you roughly 24 hours to arrange the next step — whether that's home care, a skilled nursing facility, or further appeal.

Financial Protection During the Appeal

This is the critical point most families miss: filing a timely appeal provides automatic financial protection. While Acentra conducts its review, the hospital cannot bill your parent for additional days. There is zero financial risk to filing.

The only scenario where your parent incurs liability is if Acentra rules against them and they remain in the hospital past the noon deadline the following day.

Medicare Advantage Plans: Same Rights Apply

If your parent is enrolled in a Medicare Advantage plan rather than Original Medicare, they have identical discharge appeal rights. The same Acentra Health process applies — the MA plan cannot override federal discharge appeal protections.

What to Say When You Call

When you reach Acentra Health, provide:

  • Your parent's full name and Medicare number
  • The hospital name and unit
  • The planned discharge date
  • A brief statement of why the discharge is unsafe (be specific: "no home health agency confirmed," "can't transfer to toilet independently," "medications not reconciled")

You don't need to be a legal representative to file the appeal — any Medicare beneficiary or their family member can initiate it.

After an Unsuccessful Appeal

If Acentra rules against you, request a reconsideration through the Qualified Independent Contractor (QIC) within 60 days. Meanwhile, work with the discharge planner to ensure whatever transition happens next is as safe as possible.
