  • Specific behavioral risks: Wandering history, sundowning episodes, inability to recognize familiar people, aggressive episodes
  • Medication management: Whether the veteran can independently manage their medication regimen

  • Supervision requirements: Whether 24-hour supervision is medically necessary and why

Memory Care Costs as Medical Expense Deductions

The cost of a memory care facility qualifies as an unreimbursed medical expense for VA pension calculations. This is critical for financial eligibility: a veteran with $35,000 in annual income who pays $6,000 per month for memory care has $72,000 in annual medical expenses. After deductions, their countable income drops to zero, qualifying them for the maximum benefit.

The facility should provide a statement confirming that the care provided includes custodial services (personal care, medication management, supervision) — not just room and board.

The Fiduciary Question

When the VA determines that a beneficiary cannot manage their own finances due to cognitive impairment, it triggers the formal Fiduciary Program. This happens when:

  • The examining physician states on Form 21-2680 that the veteran cannot manage their own funds
  • A C&P examiner marks "No" on the competency section of a disability questionnaire
