Utah Guardian Competency Test: What Rule 6-501 Requires

Before a Utah court appoints you as guardian or conservator, you have to complete a competency test. It's not optional — Utah Rule of Judicial Administration 6-501 requires every proposed guardian and conservator to complete the exam and file a Declaration of Completion in the case record before appointment.

What the Test Covers

The Rule 6-501 competency test is an online exam administered through the Utah State Courts website. It evaluates whether you understand the legal responsibilities you're asking the court to assign you.

The test addresses responsibilities such as:

Guardian duties and limitations. You need to know that a guardian manages the person — housing, medical care, daily living — while a conservator manages the estate. Utah law requires guardians to make decisions in the least restrictive manner possible under Utah Code Section 75-5-304.

Reporting requirements. Guardians must file an Annual Status Report on the protected person's health and living conditions within 60 days of each anniversary of appointment. Conservators must file a 90-day Inventory Report listing all assets, plus annual financial accountings if the estate exceeds $50,000 (excluding the primary residence).

Financial management rules. Conservators have a fiduciary duty to preserve and invest estate assets prudently. The test checks whether you understand that you can't commingle funds, can't make gifts from the estate without court approval, and must maintain detailed records.

Rights of the protected person. Even under guardianship, the protected person retains certain rights. The test makes sure you understand which rights have been specifically removed by the court order and which ones remain intact.

Surety bond requirements. If you're serving as conservator, you need to understand that a surety bond is typically required, covering the total value of the estate plus one year of estimated income.

How to Prepare

The Utah Courts website links to study resources, including summaries of guardian and conservator duties under the Utah Uniform Guardianship, Conservatorship, and Other Protective Arrangements Act. Follow the current court instructions when preparing for and taking the exam.

Focus your study time on the reporting deadlines — these trip up the most people. The 90-day inventory deadline starts from the date of appointment, not the date of the hearing. The annual report deadline is tied to the appointment anniversary, not the calendar year.

Also review the distinction between full and limited guardianship. Utah courts strongly prefer limited guardianship, meaning the order should specify exactly which rights are removed rather than granting blanket authority. The test expects you to understand this preference and why it exists.

What Happens After You Complete the Test

Once you complete the test, you print and sign the Declaration of Completion of Testing, then file it with the court clerk as part of your guardianship case. The judge reviews the declaration before the hearing.

If the test is not completed or the required declaration is missing, the court cannot appoint you. Follow the current Utah Courts instructions if another attempt is required.

A Common Misunderstanding

The competency test evaluates the proposed guardian, not the person being placed under guardianship. The respondent's capacity is assessed separately through the Certificate of Medical Examination completed by a licensed physician or psychologist.

Families sometimes confuse these two requirements and arrive at the hearing with only one completed. You need both: the CME documenting your parent's incapacity, and the Declaration of Completion proving you understand what the role demands.
