NC Guardianship Forms: Complete List of Court Documents You Need

The Core Forms for NC Guardianship Proceedings

North Carolina guardianship proceedings run through the Clerk of Superior Court as "special proceedings" under Chapter 35A of the General Statutes. The Administrative Office of the Courts (AOC) publishes standardized forms for each step. Here is every form you need, in the order you will use them.

Phase 1: Filing the Petition

Form AOC-SP-200 — Petition for Adjudication of Incompetence and Application for Appointment of Guardian. This is the initiating document. It asks the court to formally determine that the respondent (your parent) is incompetent and to appoint a guardian. The petition must include specific facts demonstrating the respondent's inability to manage their own affairs — cognitive impairment, inability to handle finances, inability to make or communicate healthcare decisions.

You file AOC-SP-200 with the Clerk of Superior Court in the county where your parent resides. The filing fee is $120. Once filed, the county sheriff must personally serve your parent with a copy of the petition and a notice of hearing, which costs an additional $30.

Form AOC-SP-201 — Notice of Hearing. Issued by the Clerk after the petition is filed. This notice informs the respondent of the hearing date and their rights — including the right to attend, to retain private counsel, to present evidence, and to request a jury trial. The hearing is typically scheduled 10 to 30 days after service.

Form AOC-SP-208 — Guardianship Capacity Questionnaire. This clinical form must be completed by a physician who has evaluated the respondent. It documents the respondent's cognitive and functional deficits — specifically whether they can understand the nature and consequences of decisions about their person, property, or both. The questionnaire helps the court evaluate whether incompetence has been proven by clear, cogent, and convincing evidence.

Form AOC-SP-214 — Motion for Multidisciplinary Evaluation. Used when the court or either party wants a comprehensive clinical evaluation beyond the standard capacity questionnaire. This triggers a formal assessment by a multidisciplinary team — typically a physician, psychologist, and social worker — who examine the respondent and submit a report to the court.

Emergency Guardianship Forms

Form AOC-SP-198 — Motion for Appointment of Interim Guardian. When a parent is in immediate danger — active financial exploitation, medical neglect, or physical harm — waiting for a full hearing is not viable. This form asks the court to appoint an interim guardian on an emergency basis under N.C. Gen. Stat. § 35A-1114. The Clerk can grant interim powers within days rather than weeks. Interim guardian authority is strictly limited to addressing the immediate crisis and expires automatically after 45 days, at which point a full incompetency hearing must proceed.

Phase 2: After Adjudication — Appointment and Qualification

Form AOC-E-206 — Application for Letters of Guardianship for an Incompetent Person. Once the Clerk adjudicates the respondent as incompetent, the proposed guardian must formally apply for appointment using this form. It covers the proposed guardian's personal information, relationship to the ward, and the type of guardianship sought.

Form AOC-E-400 — Oath. The appointed guardian must take a formal fiduciary oath of office before receiving their Letters of Appointment. This oath commits the guardian to faithfully manage the ward's affairs according to law.

Letters of Appointment (Forms AOC-E-407, AOC-E-408, or AOC-E-413). These are the official court documents that prove your legal authority as guardian. Banks, hospitals, insurance companies, and government agencies will require certified copies. The specific form depends on the type of guardianship: Guardian of the Person, Guardian of the Estate, or General Guardian.

Ongoing Reporting Forms

Form AOC-E-510 — Inventory for Guardianship Estate. Due within 90 days of appointment. A Guardian of the Estate or General Guardian must file a complete inventory of the ward's assets — bank accounts, investments, real property, personal property, and outstanding liabilities — all valued as of the date of the guardian's qualification, not the filing date.

Form AOC-E-506 — Annual or Final Fiduciary Account. Due within 30 days after the end of the guardian's selected fiscal year. This sworn annual accounting must reconcile the beginning balance with all income received and expenses paid during the year. Physical vouchers or bank statements for every disbursement are required. The Clerk audits the account and charges an audit fee of $0.40 per $100 of receipts, subject to county-specific minimums and maximum caps.
