Legal Services of New Jersey (LSNJ) Medicare Savings Help: Free Legal Aid for Denials

When the Paperwork Isn't Working and You Need a Lawyer

You filed your parent's NJSave application. It was denied. The denial letter says their income is $43 over the QMB limit, but you're pretty sure the caseworker counted their pension without applying the $20 unearned income disregard. You have 20 days to request a fair hearing. You don't know how to challenge a state Medicaid determination.

This is exactly when Legal Services of New Jersey (LSNJ) enters the picture. LSNJ provides free legal representation to low-income New Jersey residents facing administrative denials and benefit terminations — including Medicare Savings Program cases. Their attorneys know N.J.A.C. 10:72 and the SSI budgeting rules by heart, and they handle the hearing paperwork and appear before the Administrative Law Judge on your parent's behalf.

What LSNJ Handles for Medicare Savings Cases

Examples of issues where legal help may be relevant include:

  • QMB, SLMB, or QI denials where the income or asset calculation appears incorrect — miscounted joint bank accounts, improperly included retirement distributions, failure to apply the $20 disregard
  • Benefit terminations at renewal — the county says income went up, but the increase was a one-time retroactive Social Security adjustment, not permanent income
  • Fair hearing representation — LSNJ files the appeal, prepares the evidence, and argues the case at the OAL hearing
  • QMB billing violations — providers billing your parent for Medicare cost-sharing despite QMB status, including cases sent to collections
  • Processing delays — applications that have been pending past the 45-day processing standard with no decision and no documented reason for the delay

How to Contact LSNJ

Call the LSNJ statewide hotline at 1-888-LSNJ-LAW (1-888-576-5529). The intake line screens for income eligibility and case type. If your parent's case qualifies, they'll assign an attorney.

If the general intake line is backed up, ask whether a senior-focused intake path is available for your parent's case.

Response time varies — LSNJ serves the entire state and operates on limited funding. Call as soon as your parent receives a denial or termination notice, and keep track of the appeal deadlines in the notice while you wait for a response.

What LSNJ Doesn't Do

LSNJ does not provide routine help with an initial NJSave filing. A county Area Agency on Aging or Aging and Disability Resource Connection may help with paper NJSave applications. LSNJ also does not provide ongoing case management, track applications through the county, or organize documents for renewals. Its role is legal intervention when the system has produced a wrong result and your parent needs someone who can seek a correction.

For the initial application, document organization, and the structured tracking that prevents denials in the first place, the New Jersey Medicare Savings Programs Guide provides the checklists, worksheets, and escalation protocols you work through before legal help becomes necessary. LSNJ is the backstop when the process fails despite doing everything right.
