Kentucky Medicare Savings Program Denial: How to Appeal and Request a Fair Hearing
What a Kentucky MSP Denial Letter Actually Tells You
When the Department for Community Based Services denies a Medicare Savings Program application, the official notice arrives as a written letter specifying the reason — income over the limit, resources above the threshold, missing documentation, or a citizenship verification issue. The letter also includes a deadline, and that deadline matters more than anything else on the page.
Kentucky gives you 30 calendar days from the date printed on the denial notice to request an administrative hearing. Miss that window and you lose the right to challenge the decision for that application cycle. You can reapply later, but the original filing date — and any retroactive coverage it would have unlocked — is gone.
Read the reason code carefully. The most common denials fall into a handful of categories: income slightly above the threshold (often because DCBS miscounted or didn't apply the $20 general unearned income disregard), bank account balances that pushed resources over the $9,950 individual or $14,910 couple limit on the wrong snapshot date, or documents that arrived after the verification window closed.
How to Request a Fair Hearing Through DCBS
The hearing request process under 907 KAR 1:563 requires a written request. Mail or deliver it to your local county DCBS office or to the state hearing branch:
- Written request — Send a signed letter to the Cabinet for Health and Family Services, Administrative Hearings Branch, 105 Sea Hero Road, Suite 2, Frankfort, KY 40601. For questions, call (502) 564-8889. State your name, case number, the benefit denied, and that you want a fair hearing.
The request must be postmarked or physically delivered within 30 calendar days of the notice date. Keep a copy and proof of the postmark or delivery. To keep existing benefits in place during an appeal, submit the request within 10 calendar days of the notice date; if the hearing officer upholds the adverse decision, you may have to repay benefits paid during the appeal.
Preparing for the Hearing
An administrative hearing officer — not the same worker who denied your application — reviews the case. You have the right to present evidence, bring witnesses, and explain your situation.
Bring these documents:
- The denial notice itself
- Your Social Security Award Letter showing current monthly benefit amount
- Bank statements for the month DCBS evaluated (the first of the month is the snapshot date for resources)
- Documentation of any excluded assets — burial reserves, vehicle title for your primary car, life insurance policies with face value under $1,500
- Proof of the $20 general unearned income disregard if DCBS didn't apply it (compare your gross Social Security to the income limit minus $20)
If the denial was for excess income, show the math. Kentucky's QMB income limit for an individual is $1,350 per month in 2026 — but that's after the $20 disregard. A gross Social Security check of $1,365 translates to $1,345 countable income, which is under the QMB ceiling. Misapplied disregards are a real source of incorrect denials.

What Happens After the Hearing
The hearing officer issues a written decision. If the decision reverses the denial, DCBS processes your MSP enrollment using the original application date. For SLMB and QI, that can mean up to three months of retroactive Part B premium coverage.
If the hearing upholds the denial, you can file a new application if your circumstances have changed.
