Appeal a Long-Term Care Subsidy Decision in PEI: Deadlines, Process, and What to Expect

Your parent's LTC subsidy application was denied, or their existing subsidy was reduced or cancelled. You disagree with the decision. In Prince Edward Island, you have the right to appeal — but the clock is ticking.

The 30-Day Appeal Deadline

From the date the denial or change notice is received, the family has exactly 30 days to submit a completed appeal letter to the Financial Assistance Appeal Panel. Miss this deadline and the decision stands. There is no extension mechanism.

This tight window is one of the most common traps families fall into. The denial letter often arrives while the family is managing a care transition, dealing with a parent's hospital discharge, or trying to understand the subsidy calculation for the first time. Thirty days disappears fast.

Why Subsidies Get Denied or Reduced

The LTC Subsidy Program calculates accommodation support using a straightforward formula based on your parent's net income from CRA Line 23600:

Annual Subsidy = $44,250.40 minus Net Income

Seniors with net income below $44,250.40 qualify for a subsidy. Those above pay the full standard rate of $116.96 per day (approximately $3,557 per month).

Common reasons for denial or reduction:

One-time income spikes. If your parent sold a property, cashed in an RRSP, or received a large insurance payout, the resulting capital gain inflates their Line 23600 for that year. A parent who normally earns $28,000 annually could show $90,000 in a year with a property sale — disqualifying them from the subsidy even though their ongoing income hasn't changed.

Incomplete documentation. The subsidy application requires specific financial documents, including the most recent CRA Notice of Assessment. If documents are missing after the initial 30-day submission window, the application is cancelled outright.

Income recalculation. Annual reassessments can catch income changes from new pension payments, GIS adjustments, or investment income that push the total above the threshold.

How the Appeal Process Works

The appeal goes to the Financial Assistance Appeal Panel, an independent body that reviews the subsidy decision.

What to include in the appeal letter:

• A clear statement that you are appealing the specific decision, referencing the denial or change notice
• The reason you believe the calculation is incorrect or the circumstances are exceptional
• Supporting documentation — CRA Notice of Assessment, proof that a one-time income spike is non-recurring, or evidence of expenses that should be considered

Financial rules during the appeal:

• New applicants: No subsidy is paid while the appeal is pending. Your parent must pay the full standard rate until the panel makes a final decision. If the appeal succeeds, the difference is refunded retroactively.
• Existing recipients: If an existing subsidy was reduced or cancelled, your parent continues receiving their previous subsidy level until the panel decides. This protection only applies to subsidies that were already in place.
• Unsuccessful appeals: If the appeal is denied, any subsidy paid during the appeal period for existing recipients becomes a debt owed to the provincial government. This is a real financial risk and should factor into the decision to appeal.

Filing a Complaint About a Nursing Home

Separate from subsidy appeals, families can file complaints about care quality, staffing, safety, or operational issues at long-term care manors.

Complaints about public manors go to the Health PEI Patient Relations office. Complaints about private nursing homes go to the Licensing and Inspection division under the Community Care Facilities and Nursing Homes Act.

For situations involving suspected abuse, neglect, or exploitation of a vulnerable adult, contact the Adult Protection Program through any regional Home Care office. Under the Adult Protection Act, protective services staff will investigate and coordinate emergency support if necessary.
