Adult Protective Services North Dakota: How to Report Elder Abuse

You suspect someone is taking advantage of your aging parent — draining their bank account, neglecting their medical needs, or worse. You've heard of Adult Protective Services but aren't sure how to reach them in North Dakota or what happens after you call.

North Dakota handles this through its Vulnerable Adult Protective Services (VAPS) program, and reporting is straightforward once you know where to go.

How to File a Report

Contact VAPS through the central Aging and Disability Resource-LINK (ADRL) at 1-855-462-5465. This is the single intake line for all elder abuse, neglect, self-neglect, and financial exploitation reports in North Dakota.

You can also file online through the HHS reporting portal. Reports can be made anonymously, though providing contact information allows investigators to follow up for additional details.

What VAPS Investigates

VAPS handles reports involving vulnerable adults who are unable to protect themselves from harm. The categories include:

Physical abuse — hitting, pushing, restraining, or any physical contact that causes injury or pain.

Neglect — failure by a caregiver to provide necessary food, shelter, medical care, clothing, or supervision.

Self-neglect — when the adult themselves is unable to meet their own basic needs due to cognitive or physical decline. This is the most common type of report and can trigger state intervention even without a third-party abuser.

Financial exploitation — unauthorized use of an adult's funds, property, or assets. This includes forged checks, pressure to change a will, unauthorized credit card charges, and scam-related theft.

What Happens After You Report

VAPS assigns an investigator who typically contacts the alleged victim within days. The investigator will:

• Interview the vulnerable adult privately
• Review medical and financial records (with consent or court order)
• Interview the alleged abuser and witnesses
• Evaluate the living environment
• Determine whether the report is substantiated

If the investigation confirms abuse or neglect, VAPS can coordinate with law enforcement, arrange emergency protective services, and work with the court system to pursue guardianship or other legal interventions.

The Connection to Legal Authority

One of the most common scenarios that triggers a VAPS investigation is financial exploitation by a family member or caregiver who has informal access to the parent's money but no legal authority — or who has abused the authority granted by a poorly drafted power of attorney.

A properly structured durable power of attorney with clear limits, explicit gifting restrictions, and accountability provisions can prevent exploitation before it starts. Under NDCC Section 30.1-30-06, an agent cannot make gifts of the principal's property unless the POA expressly authorizes it — a safeguard that generic templates often lack.

On the protective side, if you suspect someone else is exploiting your parent, having your own legal authority (POA or guardianship) gives you standing to:

• Access bank statements and financial records
• Close accounts being drained
• Redirect government benefits away from an exploiter
• Work with VAPS investigators to provide evidence

Without legal authority, you may be able to report the abuse but have no ability to stop it directly.

When VAPS Isn't Enough

VAPS investigates and coordinates services, but they don't provide legal representation or file court documents on the family's behalf. If your parent is being exploited and you need immediate legal authority to intervene, you may need to pursue emergency guardianship under NDCC 30.1-28-10.1 — which the court can grant within days when immediate danger exists.
